지방자치단체를 당사자로 하는 계약에 관한 법률 시행령 제78조(장기계속계약과 계속비계약)

① 다음 각 호의 어느 하나에 해당하는 계약으로서 법 제24조에 따라 장기계속계약을 체결하려는 경우에는 해당 지방자치단체의 장의 승인을 받아 단가에 대한 계약으로 체결할 수 있다. <개정 2015.8.19>

② 장기계속공사는 낙찰 등에 의하여 결정된 총공사금액을 덧붙여 적고 해당 연도의 예산의 범위에서 제1차공사를 이행하도록 계약을 체결하여야 한다. 이 경우 제2차공사 이후의 계약은 덧붙여 적은 총공사금액(제73조부터 제75조까지의 규정에 따른 계약금액의 조정이 있는 경우에는 조정된 총공사금액을 말한다)에서 이미 계약된 금액을 공제한 금액의 범위에서 체결할 것을 부관(附款)으로 약정하여야 한다.

③ 장기물품제조등과 정보시스템 구축사업(구축사업과 함께 해당 정보시스템의 운영 및 유지보수사업을 포괄하여 계약을 체결하는 경우를 포함한다)의 계약체결방법에 관하여는 제2항을 준용한다. <개정 2015.8.19>

④ 제2항과 제3항에 따른 차수별 계약금액은 총공사ㆍ총제조 등의 계약단가에 따라 결정한다.

⑤ 「지방재정법」 제42조에 따른 계속비 예산으로 집행하는 공사에서는 총공사와 연차별 공사에 관한 사항을 명백히 하여 계약을 체결하여야 한다.
