지방자치단체를 당사자로 하는 계약에 관한 법률 시행령 제78조의2(단년도 차수계약)

① 지방자치단체의 장 또는 계약담당자는 같은 회계연도 내에 전체 예산의 확보가 예상되는 경우로서 설계서ㆍ규격서 등이 미리 확정된 경우에는 총액으로 입찰하여 낙찰된 자와 예산이 확보되는 범위에서 시기별로 나누어 계약을 체결할 수 있다.

② 지방자치단체의 장 또는 계약담당자는 제1항에 따라 시기별로 나누어 계약을 체결하는 경우 낙찰된 금액을 계약서에 덧붙여 적되, 예산의 범위에서 1차 계약을 체결하고 2차 이후의 계약은 덧붙여 적은 금액에서 1차 계약금액을 공제한 금액의 범위에서 체결할 것을 부관으로 약정하여야 한다.
