지방자치단체를 당사자로 하는 계약에 관한 법률 시행령 제15조(공사의 입찰)

① 지방자치단체의 장 또는 계약담당자는 공사를 입찰에 부치려는 경우에는 설계서, 공종별(工種別) 목적물 물량내역서(이하 "물량내역서"라 한다), 그 밖에 행정안전부령으로 정하는 입찰에 관한 서류(이하 "입찰에 관한 서류"라 한다)를 작성하여 갖춰 두어야 하며, 입찰공고일부터 입찰등록 마감일까지 입찰에 참가하려는 자에게 이를 열람하게 하고 교부하여야 한다. 이 경우 지정정보처리장치에 이를 게재함으로써 열람 또는 교부를 갈음할 수 있다. <개정 2013.3.23, 2014.11.19, 2016.9.13, 2017.7.26>

③ 지방자치단체의 장 또는 계약담당자는 공사를 입찰에 부치려는 경우에는 입찰서 제출 마감일 전에 미리 현장설명을 하여야 한다. 다만, 공사의 성질상 현장설명을 할 필요가 없다고 인정될 때에는 그러하지 아니하다.

④ 제3항에 따른 현장설명은 공사의 규모에 따라 해당 입찰서 제출 마감일의 전날부터 기산(起算)하여 다음 각 호의 구분에 따른 기간 전에 실시하여야 한다. 다만, 제35조제4항에 따른 경우에는 그 기간을 단축할 수 있다.

⑤ 지방자치단체의 장 또는 계약담당자는 추정가격이 300억원 이상인 공사입찰 시 제3항과 제4항에 따라 현장설명을 하는 경우에는 현장설명에 참가한 자만을 입찰에 참가하게 하여야 한다.

⑥ 지방자치단체의 장 또는 계약담당자는 공사입찰 시 입찰자로 하여금 입찰서에 입찰총액을 적게 하되, 물량내역서에 단가를 적은 입찰금액 산출내역서(이하 "산출내역서"라 한다)를 입찰서에 첨부하게 하여야 한다. 다만, 추정가격이 100억원 미만인 공사 또는 제19조제1항에 따라 재입찰에 부치는 공사의 경우에는 낙찰자가 착공신고서를 제출할 때 산출내역서를 제출하도록 하여야 한다. <개정 2016.9.13>

⑦ 제6항에 따른 산출내역서는 다음 각 호의 구분에 따른 방법에 따라 작성하도록 하여야 한다. <개정 2011.9.15, 2016.1.15>

⑧ 장기계속공사(「지방재정법」 제42조에 따른 계속비에 의한 공사를 포함한다)의 경우에는 총공사를 대상으로 하여 입찰하게 하여야 한다.

⑨ 지방자치단체의 장 또는 계약담당자는 제79조제1항제2호에 따른 단가계약 체결을 위한 입찰을 실시하는 경우에는 총액으로 입찰을 실시하되, 계약체결 시 총액에 대한 단가 산출내역서를 제출하게 하여야 한다.
