지방세특례제한법 시행령 제15조(주택건설사업자의 범위 등)

① 법 제33조제1항에서 "대통령령으로 정하는 주택건설사업자"란 다음 각 호의 어느 하나에 해당하는 자를 말한다. <개정 2013.6.28, 2016.8.11>

③ 법 제33조제2항에서 "대통령령으로 정하는 1가구 1주택"이란 취득일 현재 취득자와 같은 세대별 주민등록표에 기재되어 있는 가족(동거인은 제외한다)으로 구성된 1가구(취득자의 배우자, 취득자의 미혼인 30세 미만의 직계비속 또는 취득자가 미혼이고 30세 미만인 경우 그 부모는 각각 취득자와 같은 세대별 주민등록표에 기재되어 있지 아니하더라도 같은 가구에 속한 것으로 본다)가 국내에 1개의 주택을 소유하는 것을 말하며, 주택의 부속토지만을 소유하는 경우에도 주택을 소유한 것으로 본다. 이 경우 65세 이상인 직계존속, 「국가유공자 등 예우 및 지원에 관한 법률」에 따른 국가유공자(상이등급 1급부터 7급까지의 판정을 받은 국가유공자만 해당한다)인 직계존속 또는 「장애인복지법」에 따라 등록한 장애인(장애의 정도가 심한 장애인만 해당한다)인 직계존속을 부양하고 있는 사람은 같은 세대별 주민등록표에 기재되어 있더라도 같은 가구에 속하지 아니하는 것으로 본다. <개정 2016.12.30, 2018.12.31>
