주한미군기지 이전에 따른 평택시 등의 지원 등에 관한 특별법 제33조의2(마을 공동이용시설의 무상 양여)

① 평택시등의 장은 제33조제1항에 따른 이주대책으로 이주단지에 설치된 마을회관, 공동창고 등 대통령령으로 정하는 공동이용시설을 「공유재산 및 물품관리법」 제19조에도 불구하고 대통령령으로 정하는 마을회 등 주민공동체(이하 이 조에서 "주민공동체"라 한다)에 무상으로 양여할 수 있다.

② 주민공동체는 제1항에 따라 무상으로 양여받은 공동이용시설에 대하여 평택시등의 장의 동의 없이는 이를 양도하거나 제한물권을 설정해서는 아니 된다.

③ 주민공동체는 무상으로 양여받은 공동이용시설에 관한 소유권등기에 평택시등의 장의 동의 없이는 양도 또는 제한물권을 설정하거나 압류ㆍ가압류ㆍ가처분 등의 목적물이 될 수 없는 재산임을 대통령령으로 정하는 바에 따라 부기등기(附記登記)하여야 한다. 이 경우 부기등기는 소유권보존등기 또는 이전등기와 동시에 신청하여야 한다.

④ 부기등기 이후에 부기등기의 내용을 위반하여 한 계약, 처분, 그 밖의 행위는 무효로 한다.
