Enforcement Decree of the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of Free International City, Article 46 (Special Provisions on the Operation of Autonomous Schools)

① 자율학교의 장은 법 제216조제1항ㆍ제4항에 따라 자율학교 운영에 관하여 다음 각 호의 사항을 달리 정할 수 있다.

1. 「초ㆍ중등교육법」 제23조제2항ㆍ제3항과 같은 법 시행령 제43조에 따른 교육과정과 교과. 다만, 국어 교과, 사회 교과(초등학교 1학년과 2학년의 사회 교과는 슬기로운 생활을 말하고, 중학교와 고등학교의 사회 교과는 한국사를 포함한다. 이하 이 조에서 같다) 및 도덕 교과(초등학교만 해당하며, 초등학교 1학년과 2학년은 바른 생활을 말한다. 이하 이 조에서 같다)의 교육과정은 교육부장관이 정하는 바에 따르고, 공통 교육과정(교육부장관이 고시한 교육과정 중에서 초등학교 1학년부터 중학교 3학년까지 편성되는 교육과정을 말한다)의 교과인 경우에는 교과별 총수업시간의 2분의 1을 초과하여 달리 정할 수 없으며, 선택 교육과정(교육부장관이 고시한 교육과정 중에서 고등학교 1학년부터 3학년까지 편성되는 교육과정을 말한다)의 교과인 경우에는 총필수이수단위의 2분의 1 이상을 이수하도록 하여야 한다.

3. 「초ㆍ중등교육법」 제24조제3항과 같은 법 시행령 제44조 및 제45조에 따른 학기와 수업일수. 다만, 수업일수를 줄이는 경우 그 단축 수업일수는 같은 법 시행령 제45조에 따른 수업일수의 100분의 20 이내로 한다.

5. 「초ㆍ중등교육법」 제31조와 같은 법 시행령 제58조ㆍ제63조에 따른 학교운영위원회 위원의 정수와 구성비율. 다만, 위원의 정수와 구성비율을 달리하는 경우 그 조정 범위는 각각 같은 조에 따른 위원의 정수와 구성비율의 100분의 20을 초과해서는 아니 된다.

1. 「초ㆍ중등교육법」 제19조제4항에 따른 교원의 배치기준(그 교원의 배치기준 이상으로 교원을 배치하는 경우만 해당한다)

④ 자율학교에는 법 제216조제1항ㆍ제4항에 따라 「초ㆍ중등교육법」 제21조제1항에 따른 교장 자격 또는 교감 자격이 없는 사람을 교장 또는 교감으로 임용할 수 있다.

⑤ 자율학교에는 법 제216조제1항ㆍ제4항에 따라 전문대학 졸업자 또는 이와 같은 수준 이상의 학력이 있는 사람으로서 도교육감이 정하여 고시하는 법인ㆍ단체에서 담당 교과와 관련되는 분야의 직무에 5년 이상 근무한 사람을 「초ㆍ중등교육법 시행령」 별표 2 제1호에도 불구하고 「초ㆍ중등교육법」 제22조에 따른 산학겸임교사로 임용할 수 있다.

⑥ 자율학교의 장은 법 제216조제1항ㆍ제4항에 따라 「초ㆍ중등교육법」 제29조제1항의 교과용 도서 외에 국내외에서 출판된 도서를 교과용 도서(초ㆍ중등학교 교육과정의 국어 교과, 사회 교과 및 도덕 교과는 제외한다. 이하 이 조에서 같다)로 사용할 수 있다. 이 경우 미리 제7항에 따른 교과용도서선정심의회의 심의를 마쳐야 한다. <개정 2025.11.25>

⑧ 법 제216조제2항ㆍ제4항에 따라 자율학교의 장이 교원의 임용 또는 소속 교원의 전보유예를 요청하는 경우에는 해당 교원의 동의를 받아야 하며, 임용권자는 이를 존중하여야 한다.

⑪ 제1항부터 제10항까지에서 규정한 사항 외에 자율학교의 운영과 지원 등에 필요한 사항은 제주자치도의 교육규칙으로 정한다.
