Special Act on Fostering and Supporting the Pharmaceutical Industry, Article 2 (Definitions)

1. "제약산업"이란 「약사법」 제2조제4호에 따른 의약품을 연구개발ㆍ제조ㆍ가공ㆍ보관ㆍ유통하는 것과 관련된 산업을 말한다.

2. "제약기업"이란 국내에서 제약산업과 관련된 경제활동을 하는 다음 각 목의 어느 하나에 해당하는 기업을 말한다.

가. 「약사법」 제31조에 따라 의약품 제조업 허가 또는 제조판매품목허가를 받거나 제조판매품목신고를 한 기업

나. 외국계 제약기업으로서 「약사법」 제42조에 따라 의약품 수입품목허가를 받거나 수입품목신고를 한 기업

(b)비 A어 foreign^f포^r런 pharmaceutical^f파머수티클 company컴퍼니 that^ð댓 has해즈 obtained어브테인드 permission퍼미션 for^f포 an앤 imported임포티드 item아이텀 or오 reported^r리포티드 an앤 imported임포티드 item아이텀 for^f포 medicines메더슨즈 under언더 Article아터클 42 of어^v브 the^ð더 Pharmaceutical^f파머수티클 Affairs어^f페어즈 Act;액트

다. 「벤처기업육성에 관한 특별법」 제2조의2에 따른 벤처기업 중 신약 연구개발을 전문으로 하는 기업

(c)시 Among어멍 venture^v벤처 businesses비즈너시즈 under언더 Article아터클 2-2 of어^v브 the^ð더 Special스페실 Act액트 on안 the^ð더 Promotion프^r러모우션 of어^v브 Venture^v벤처 Businesses,비즈너시즈 a어 company컴퍼니 specializing스페셜라이징 in인 research^r리서치 and앤드 development디^v벨럽먼트 of어^v브 new누 drugs;드^r러그즈 and앤드

라. 신약 연구개발 등을 전문적으로 수행하기 위하여 조직, 인력 등 대통령령으로 정하는 기준을 충족하는 기업

(d)디 A어 company컴퍼니 that^ð댓 meets밋츠 the^ð더 criteria크^r라이티^r리아 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree,디크^r리 such서치 as애즈 organization오거너제이션 and앤드 personnel,퍼서넬 to투 professionally프^r러^f페셔널리 conduct칸덕트 research^r리서치 and앤드 development디^v벨럽먼트 of어^v브 new누 drugs,드^r러그즈 etc.엣세터^r러

3. "혁신형 제약기업"이란 다음 각 목의 어느 하나에 해당하는 기업으로서 제7조에 따라 보건복지부장관으로부터 인증을 받은 제약기업을 말한다.

3. "Innovative이너^v베이티^v브 pharmaceutical^f파머수티클 company"컴퍼니 means민즈 a어 pharmaceutical^f파머수티클 company컴퍼니 that^ð댓 falls^f폴즈 under언더 any에니 of어^v브 the^ð더 following^f팔로잉 items아이텀즈 and앤드 is이즈 certified서터^f파이드 by바이 the^ð더 Minister미너스터 of어^v브 Health헬^θ스 and앤드 Welfare웰^f페어 under언더 Article아터클 7:

가. 신약 연구개발 등에 대통령령으로 정하는 규모 이상의 투자를 하는 제약기업

(a)어 A어 pharmaceutical^f파머수티클 company컴퍼니 that^ð댓 invests인^v베스츠 in인 research^r리서치 and앤드 development디^v벨럽먼트 of어^v브 new누 drugs,드^r러그즈 etc.엣세터^r러 in인 an앤 amount어마운트 at앳 or오 above어버^v브 the^ð더 scale스케일 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree;디크^r리 and앤드

나. 국내에서 대통령령으로 정하는 규모 이상의 신약 연구개발 투자실적이 있거나 신약 연구개발을 수행하고 있는 외국계 제약기업
