정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률 시행령 제39조(민감정보 및 고유식별정보의 처리)
Enforcement Decree of the Act on the Improvement of Mental Health and the Support for Welfare Services for Mental Patients, Article 39 (Processing of Sensitive Information and Personally Identifiable Information)
① 보건복지부장관(법 제38조의2제4항, 이 영 제10조, 제10조의3, 제10조의4, 제13조, 제34조 또는 제38조에 따라 보건복지부장관으로부터 권한ㆍ업무를 위임ㆍ위탁받거나 권역별트라우마센터로 지정받은 자를 포함한다) 또는 지방자치단체의 장(해당 권한ㆍ업무를 위임ㆍ위탁받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. 다만, 제4호부터 제7호까지의 규정 및 제10호에 따른 사무의 경우에는 「개인정보 보호법」 제23조에 따른 건강에 관한 정보는 제외한다. <개정 2018.12.11, 2019.6.11, 2019.10.22, 2021.6.15, 2025.12.30>
(1) The Minister of Health and Welfare (including a person who has been delegated or entrusted with authority or affairs by the Minister of Health and Welfare under Article 38-2 (4) of the Act or Article 10, 10-3, 10-4, 13, 34, or 38 of this Decree, or who has been designated as a regional trauma center) or the head of a local government (including a person who has been delegated or entrusted with the relevant authority or affairs) may, where inevitable for performing any of the following affairs, process data containing information on health under Article 23 of the Personal Information Protection Act or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of that Act: Provided, That for the affairs under subparagraphs 4 through 7 and subparagraph 10, information on health under Article 23 of the Personal Information Protection Act is excluded:
1. 법 제10조제1항에 따른 실태조사에 관한 사무
1. Affairs concerning the fact-finding survey under Article 10 (1) of the Act;
2. 법 제11조제2항에 따른 정신건강증진사업에 관한 사무
2. Affairs concerning mental health promotion projects under Article 11 (2) of the Act;
3. 법 제15조제1항부터 제4항까지의 규정에 따른 정신건강복지센터의 설치ㆍ운영 및 정신건강증진사업등의 제공ㆍ연계 사업에 관한 사무
3. Affairs concerning the establishment and operation of mental health welfare centers and projects for providing and linking mental health promotion projects, etc. under Article 15 (1) through (4) of the Act;
3의2. 법 제15조의2제1항부터 제3항까지의 규정에 따른 국가트라우마센터와 권역별트라우마센터의 업무에 관한 사무
3-2. Affairs concerning the duties of the National Trauma Center and regional trauma centers under Article 15-2 (1) through (3) of the Act;
3의3. 법 제15조의3제1항 및 제2항에 따른 중독관리통합지원센터의 설치ㆍ운영 및 중독 문제와 관련한 지원사업에 관한 사무
3-3. Affairs concerning the establishment and operation of integrated addiction management support centers and support projects relating to addiction problems under Article 15-3 (1) and (2) of the Act;
4. 법 제17조제1항, 제3항 및 제7항에 따른 정신건강전문요원 자격 부여, 보수교육 실시 및 자격 정지ㆍ취소에 관한 사무
4. Affairs concerning the granting of qualifications of mental health professionals, the provision of continuing education, and the suspension and revocation of qualifications under Article 17 (1), (3), and (7) of the Act;
5. 법 제19조제2항에 따른 정신의료기관 개설ㆍ설치 결격사유 확인에 관한 사무
5. Affairs concerning verification of grounds for disqualification for opening or establishing psychiatric medical institutions under Article 19 (2) of the Act;
6. 법 제22조제2항 및 제3항에 따른 정신요양시설의 허가 및 설치 결격사유 확인에 관한 사무
6. Affairs concerning permission for and verification of grounds for disqualification for establishing mental health sanatoriums under Article 22 (2) and (3) of the Act;
7. 법 제26조제2항에 따른 정신재활시설의 신고 및 변경신고에 관한 사무
7. Affairs concerning reports and reports of changes of psychiatric rehabilitation facilities under Article 26 (2) of the Act;
8. 법 제38조의2에 따른 절차조력에 관한 사무
8. Affairs concerning procedural assistance under Article 38-2 of the Act;
9. 법 제38조의3에 따른 성년후견제 이용지원에 관한 사무
9. Affairs concerning support for use of the adult guardianship system under Article 38-3 of the Act;
10. 법 제44조제3항, 제4항, 제6항, 제7항 및 제9항에 따른 입원의 진단, 의뢰, 호송을 위한 도움 요청에 관한 사무
10. Affairs concerning diagnosis for admission, referral, and requests for assistance with transport under Article 44 (3), (4), (6), (7), and (9) of the Act;
11. 법 제51조에 따른 신상정보 확인, 결과 통보, 관할 경찰서장에 대한 확인 요청에 관한 사무
11. Affairs concerning confirmation of personal information, notification of results, and requests to the head of the competent police station for confirmation under Article 51 of the Act;
12. 법 제53조제2항, 제3항 및 제6항에 따른 심의, 심사 및 조사 요청에 관한 사무
12. Affairs concerning requests for deliberation, review, and investigation under Article 53 (2), (3), and (6) of the Act;
13. 법 제55조부터 제57조까지의 규정 및 제59조에 따른 퇴원등의 심사 청구 처리 및 그 결과의 통지에 관한 사무
13. Affairs concerning the handling of requests for review of discharge, etc. and notification of the results under Articles 55 through 57 and 59 of the Act;
14. 법 제60조에 따른 재심사 청구 처리 및 심사에 관한 사무
14. Affairs concerning the handling of requests for re-review and review under Article 60 of the Act;
15. 법 제62조에 따른 입원의 해제에 관한 사무
15. Affairs concerning release from admission under Article 62 of the Act;
16. 법 제63조에 따른 임시 퇴원의 경과 관찰에 관한 사무
16. Affairs concerning follow-up observation of temporary discharge under Article 63 of the Act;
17. 법 제64조에 따른 외래치료 지원 등에 관한 사무
17. Affairs concerning support for outpatient treatment, etc. under Article 64 of the Act;
18. 법 제66조제1항, 제2항 및 제4항에 따른 정신건강증진시설의 지도ㆍ감독 및 심사와 그에 따른 명령에 관한 사무
18. Affairs concerning guidance and supervision of mental health promotion facilities and review and orders thereunder under Article 66 (1), (2), and (4) of the Act;
19. 법 제67조에 따른 입ㆍ퇴원등관리시스템의 운영 및 관리에 관한 사무
19. Affairs concerning the operation and management of the admission and discharge management system under Article 67 of the Act.
② 입원적합성심사위원회 또는 조사원은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.
(2) An Admission Appropriateness Review Committee or an investigator may, where inevitable for performing any of the following affairs, process data containing information on health under Article 23 of the Personal Information Protection Act or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of that Act:
1. 법 제47조에 따른 입원등의 적합 또는 부적합 여부 심사 및 그 결과의 통지에 관한 사무
1. Affairs concerning review of whether admission, etc. is appropriate or inappropriate and notification of the results under Article 47 of the Act;
2. 법 제48조제1항 및 제2항에 따른 조사에 관한 사무
2. Affairs concerning investigations under Article 48 (1) and (2) of the Act.
③ 정신의료기관등의 장은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2019.10.22>
(3) The head of a psychiatric medical institution, etc. may, where inevitable for performing any of the following affairs, process data containing information on health under Article 23 of the Personal Information Protection Act or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of that Act:
1. 법 제41조에 따른 입원등 및 퇴원등에 관한 사무
1. Affairs concerning admission, etc. and discharge, etc. under Article 41 of the Act;
2. 법 제42조에 따른 입원등 및 퇴원등에 관한 사무
2. Affairs concerning admission, etc. and discharge, etc. under Article 42 of the Act;
3. 법 제43조에 따른 입원등 및 퇴원등에 관한 사무와 입원등 기간 연장 심사 청구에 관한 사무
3. Affairs concerning admission, etc. and discharge, etc. under Article 43 of the Act and affairs concerning requests for review of extension of the period of admission, etc.;
4. 법 제44조에 따른 입원에 관한 사무
4. Affairs concerning admission under Article 44 of the Act;
5. 법 제50조에 따른 입원 및 퇴원에 관한 사무
5. Affairs concerning admission and discharge under Article 50 of the Act;
6. 법 제52조제1항에 따른 퇴원등의 통보에 관한 사무
6. Affairs concerning notification of discharge, etc. under Article 52 (1) of the Act;
7. 법 제62조제1항 및 제2항에 따른 퇴원등 및 입원등의 기간 연장 심사에 관한 사무
7. Affairs concerning review of discharge, etc. and extension of the period of admission, etc. under Article 62 (1) and (2) of the Act;
8. 법 제63조제1항에 따른 임시 퇴원등에 관한 사무
8. Affairs concerning temporary discharge, etc. under Article 63 (1) of the Act;
9. 법 제64조제1항 및 제2항에 따른 외래치료 지원 청구에 관한 사무
9. Affairs concerning requests for support for outpatient treatment under Article 64 (1) and (2) of the Act;
10. 법 제65조제1항에 따른 무단으로 퇴원등을 한 사람에 대한 탐색 요청에 관한 사무
10. Affairs concerning requests for search for persons who have left without permission, etc. under Article 65 (1) of the Act;
11. 법 제67조제2항에 따른 입ㆍ퇴원등관리시스템 등록에 관한 사무
11. Affairs concerning registration in the admission and discharge management system under Article 67 (2) of the Act;
12. 법 제73조제1항에 따른 특수치료에 관한 사무
12. Affairs concerning special treatment under Article 73 (1) of the Act.
④ 정신건강의학과전문의 또는 정신건강전문요원은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.
(4) A psychiatrist or mental health professional may, where inevitable for performing any of the following affairs, process data containing information on health under Article 23 of the Personal Information Protection Act or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of that Act:
1. 법 제43조제1항, 제4항 및 제6항에 따른 진단에 관한 사무
1. Affairs concerning diagnosis under Article 43 (1), (4), and (6) of the Act;
2. 법 제44조제1항, 제4항 및 제6항에 따른 진단ㆍ보호 신청 및 진단에 관한 사무
2. Affairs concerning applications for diagnosis and protection and diagnosis under Article 44 (1), (4), and (6) of the Act;
3. 법 제50조제4항에 따른 진단에 관한 사무
3. Affairs concerning diagnosis under Article 50 (4) of the Act;
4. 법 제62조제2항에 따른 진단에 관한 사무
4. Affairs concerning diagnosis under Article 62 (2) of the Act;
5. 법 제63조제1항에 따른 진단에 관한 사무
5. Affairs concerning diagnosis under Article 63 (1) of the Act.
⑤ 협의체의 구성원은 법 제73조제1항에 따른 특수치료의 결정에 관한 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.
(5) Members of the consultative body may, where inevitable for performing affairs concerning the decision on special treatment under Article 73 (1) of the Act, process data containing information on health under Article 23 of the Personal Information Protection Act or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of that Act.
⑥ 법 제38조의3제1항 및 제2항에 따라 선임된 후견인은 법 제38조의3에 따른 성년후견제 이용지원에 관한 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보나 같은 법 시행령 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <신설 2025.12.30>
(6) A guardian appointed under Article 38-3 (1) and (2) of the Act may, where inevitable for performing affairs concerning support for use of the adult guardianship system under Article 38-3 of the Act, process data containing information on health under Article 23 of the Personal Information Protection Act or resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 of the Enforcement Decree of that Act.
