① 산악관광사업에 대해서는 법 제57조제1항에 따라 보전산지(「산지관리법」 제9조제1항에 따른 산지전용ㆍ일시사용제한지역은 제외한다)에서 다음 각 호의 어느 하나에 해당하는 행위를 하기 위하여 산지전용 또는 산지일시사용을 하는 경우를 제외하고는 산지전용 또는 산지일시사용을 할 수 없다.

나. 전용하려는 산지를 면적 100제곱미터의 지역으로 분할하여 각 지역의 경사도를 측정하는 경우 경사도가 35도 이상인 지역의 면적이 전체 지역 면적의 100분의 40 이하일 것. 다만, 「체육시설의 설치ㆍ이용에 관한 법률」 제10조제1항제1호에 따른 스키장업의 시설을 설치하는 경우에는 그렇지 않다.
