위치정보의 보호 및 이용 등에 관한 법률 시행령 제37조의2(권한 또는 업무의 위임ㆍ위탁)
Enforcement Decree of the Act on the Protection, Use, etc. of Location Information, Article 37-2 (Delegation and Entrustment of Authority or Work)
① 방송미디어통신위원회는 법 제38조제1항에 따라 다음 각 호의 권한을 방송미디어통신사무소 소장에게 위임한다. <신설 2026.2.10>
(1) Under Article 38 (1) of the Act, the Media and Communications Commission delegates the following authority to the Directors of Media and Communications Offices:
1. 법 제5조제2항에 따른 개인위치정보사업 변경신고의 접수
1. Receipt of reports of change of personal location information businesses under Article 5 (2) of the Act;
2. 법 제5조의2제1항에 따른 사물위치정보사업 신고의 수리
2. Acceptance of reports of object location information businesses under Article 5-2 (1) of the Act;
3. 법 제5조의2제3항제1호ㆍ제2호에 해당하는 사항에 대한 변경신고의 접수 및 같은 항 제3호에 해당하는 사항에 대한 변경신고의 수리
3. Receipt of reports of change on the matters falling under Article 5-2 (3) 1 and 2 of the Act, and acceptance of reports of change on the matters falling under subparagraph 3 of the same paragraph;
4. 법 제7조제4항에 따른 사물위치정보사업의 양수, 상속 및 법인의 합병ㆍ분할 신고의 수리
4. Acceptance of reports of acquisition, succession, and merger or split of corporations of object location information businesses under Article 7 (4) of the Act;
5. 법 제8조제1항제2호에 따른 사물위치정보사업의 휴업 및 같은 조 제2항제2호에 따른 사물위치정보사업의 폐업 신고의 수리
5. Acceptance of reports of suspension of object location information businesses under Article 8 (1) 2 of the Act and closure of object location information businesses under Article 8 (2) 2 of the Act;
6. 법 제9조제1항에 따른 위치기반서비스사업 신고의 수리
6. Acceptance of reports of location-based service businesses under Article 9 (1) of the Act;
7. 법 제9조제3항제1호ㆍ제2호에 해당하는 사항에 대한 변경신고의 접수 및 같은 항 제3호에 해당하는 사항에 대한 변경신고의 수리
7. Receipt of reports of change on the matters falling under Article 9 (3) 1 and 2 of the Act, and acceptance of reports of change on the matters falling under subparagraph 3 of the same paragraph;
8. 법 제9조의2제1항 단서에 따른 신고 및 같은 조 제3항에 따른 변경신고의 접수
8. Receipt of reports under the proviso to Article 9-2 (1) of the Act and reports of change under paragraph (3) of the same Article;
9. 법 제9조의2제4항에 따른 신고의 수리
9. Acceptance of reports under Article 9-2 (4) of the Act;
10. 법 제10조제1항에 따른 위치기반서비스사업의 양수, 상속 및 법인의 합병ㆍ분할 신고의 수리
10. Acceptance of reports of acquisition, succession, and merger or split of corporations of location-based service businesses under Article 10 (1) of the Act;
11. 법 제11조제1항에 따른 위치기반서비스사업의 휴업 및 같은 조 제2항에 따른 위치기반서비스사업의 폐업 신고의 접수
11. Receipt of reports of suspension of location-based service businesses under Article 11 (1) of the Act and closure of location-based service businesses under paragraph (2) of the same Article.
② 방송미디어통신위원회는 법 제38조제2항에 따라 다음 각 호의 업무를 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제52조에 따른 한국인터넷진흥원에 위탁한다. <개정 2025.10.1, 2026.2.10>
(2) Under Article 38 (2) of the Act, the Media and Communications Commission entrusts the following work to the Korea Internet and Security Agency under Article 52 of the Act on Promotion of Information and Communications Network Utilization and Information Protection:
1. 법 제16조제3항에 따른 기술적ㆍ관리적 조치의 내용 및 기록의 보존실태 점검에 관한 업무(기술적 지원업무로 한정한다)
1. Work concerning inspection of the content of technical and administrative measures and the status of preservation of records under Article 16 (3) of the Act (limited to technical support work);
2. 법 제36조제1항 및 제2항에 따른 자료제출 요구 및 검사에 관한 업무(기술적 지원업무로 한정한다)
2. Work concerning requests for submission of materials and inspections under Article 36 (1) and (2) of the Act (limited to technical support work).
③ 방송미디어통신위원회는 법 제38조제2항에 따라 법 제34조에 따른 표준화의 추진에 관한 업무를 「방송통신발전 기본법」 제34조에 따른 한국정보통신기술협회에 위탁한다. <개정 2025.10.1, 2026.2.10>
(3) Under Article 38 (2) of the Act, the Media and Communications Commission entrusts work concerning the promotion of standardization under Article 34 of the Act to the Telecommunications Technology Association under Article 34 of the Framework Act on the Development of Broadcasting and Communications.
