위치정보의 보호 및 이용 등에 관한 법률 시행령 제10조(소상공인 등의 위치기반서비스사업의 신고)

① 법 제9조의2제1항 각 호 외의 부분 단서에 따라 위치기반서비스사업을 신고하려는 자는 「소상공인기본법」 제2조에 따른 소상공인이나 「1인 창조기업 육성에 관한 법률」 제2조에 따른 1인 창조기업(이하 "소상공인등"이라 한다)임을 증명하는 서류(전자문서를 포함한다) 및 소상공인등의 위치기반서비스사업신고서(전자문서로 된 신고서를 포함한다)를 제출하거나, 방송미디어통신위원회가 지정하는 정보시스템에 신고사항을 입력하여야 한다. <개정 2021.2.2, 2025.10.1>

② 법 제9조의2제3항에 따라 변경신고를 하려는 자는 소상공인등의 위치기반서비스사업변경신고서(전자문서로 된 신고서를 포함한다)를 방송미디어통신위원회에 제출하거나, 방송미디어통신위원회가 지정하는 정보시스템에 변경신고사항을 입력하여야 한다. <개정 2025.10.1>

③ 법 제9조의2제4항에 따라 신고하려는 자는 위치기반서비스사업신고서에 다음 각 호의 서류(전자문서를 포함한다)를 첨부하여 방송미디어통신위원회에 제출하여야 한다. <개정 2025.10.1>

④ 방송미디어통신위원회는 제1항부터 제3항까지의 규정에 따른 신고를 받으면 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 법인 등기사항증명서 또는 사업자등록증명을 확인하여야 한다. 다만, 신고인이 사업자등록증명의 확인에 동의하지 아니하는 경우에는 그 서류를 첨부하도록 하여야 한다. <개정 2024.4.23, 2025.10.1>
