Promotion of Motion Pictures and Video Products Act, Article 25-2 (Collection of Levies)

① 영화진흥위원회는 한국영화의 발전 및 영화ㆍ비디오물산업의 진흥을 위하여 영화상영관(비상설상영장을 포함한다. 이하 이 조에서 같다)에 입장하는 관람객에 대하여 입장권 가액의 100분의 3에 해당하는 금액을 부과금으로 징수한다. 다만, 다음 각 호의 어느 하나에 해당하는 영화상영관에 입장하는 관람객에 대해서는 그러하지 아니하다.

1. 직전 연도에 제38조제1항제2호에 해당하는 영화를 연간 상영일수의 100분의 60 이상 상영한 영화상영관

3. 「감염병의 예방 및 관리에 관한 법률」 제2조제1호에 따른 감염병의 발생으로 입장권의 월 판매액이 감염병 발생 연도 직전 3개년간(영업기간이 3개년 미만인 경우에는 그 영업기간 동안을 말한다) 같은 달의 평균 입장권 판매액보다 대통령령으로 정하는 비율 이상 감소한 영화상영관(2개 이상의 영화상영관을 경영하는 경우에는 각 영화상영관별 입장권 판매액의 합계를 기준으로 한다). 다만, 감염병 발생 연도 직전 3개년간 같은 달의 영업일이 1개월 미만인 경우에는 그 달의 입장권 판매액을 월 판매액으로 환산한 금액을 기준으로 하고, 같은 달의 영업일이 없는 경우에는 감염병 발생 직전 연도까지 영업기간 동안의 월평균 입장권 판매액을 기준으로 한다.

② 영화상영관 경영자는 관람객으로부터 제1항에 따른 부과금을 수납하여 대통령령으로 정하는 납부기한까지 해당 부과금을 영화진흥위원회에 납부하여야 한다.

③ 제2항에 따라 영화상영관 경영자가 수납한 부과금을 납부하는 때에는 부과금수납부 사본 등 부과금 수납과 관련된 자료를 영화진흥위원회에 제출하여야 한다. 다만, 영화진흥위원회가 제39조제1항에 따른 영화상영관입장권 통합전산망을 통하여 영화상영관 경영자가 수납하여야 할 부과금 금액을 확인할 수 있는 경우에는 부과금 수납과 관련된 자료를 제출하지 아니할 수 있다.

④ 영화진흥위원회는 영화상영관 경영자가 제2항에 따라 관람객으로부터 수납한 부과금을 납부기한까지 납부하지 아니하였을 때에는 체납된 금액의 100분의 3에 상당하는 금액을 가산금으로 부과할 수 있다.

⑤ 영화진흥위원회는 영화상영관 경영자가 제2항의 부과금 및 제4항의 가산금을 납부기한까지 납부하지 아니하였을 때에는 국세 강제징수의 예에 따라 이를 징수할 수 있다.

⑥ 부과금ㆍ가산금의 징수방법, 납부기한 및 부과금 수납 관련 자료 제출 등에 필요한 사항은 대통령령으로 정한다.

⑦ 영화진흥위원회는 문화체육관광부장관의 승인을 얻어 제2항에 따른 영화상영관 경영자의 부과금 수납에 대한 위탁 수수료를 지급할 수 있다. 이 경우 수수료는 제1항에 따른 부과금 징수액의 100분의 3을 초과할 수 없다.
