양식산업발전법 제50조(허가양식업자의 지위 승계)

① 허가를 받은 양식시설을 허가양식업자로부터 상속받거나 매입 또는 임차한 자(허가양식업자가 법인인 경우에는 합병ㆍ분할 후 존속하는 법인을 포함한다)는 그 허가양식업자의 지위를 승계한다. 다만, 상속의 경우 상속인이 반대의 의사를 표시한 경우에는 그러하지 아니하다.

② 제1항 본문에 따라 허가양식업자의 지위를 승계하면 종전의 허가양식업자는 그 지위를 잃는다.

③ 제1항에 따라 허가양식업자의 지위를 승계한 자는 승계를 받은 날부터 30일 이내에 해당 허가를 한 시장ㆍ군수ㆍ구청장에게 해양수산부령으로 정하는 바에 따라 허가의 승계 사실을 신고하여야 한다. 이 경우 허가양식업자의 지위를 승계한 자가 해양수산부령으로 정하는 허가를 받은 양식업의 시설기준 및 허가양식업자의 자격을 갖추지 아니한 경우에는 그 승계를 받은 날부터 90일 이내에 그 기준과 자격을 갖추어야 한다.

④ 시장ㆍ군수ㆍ구청장은 제3항에 따른 신고를 받은 경우 그 내용을 검토하여 이 법에 적합하면 신고를 수리하여야 한다.

⑤ 제1항에 따라 허가양식업자의 지위를 승계한 자는 해당 허가양식업자에게 부과된 행정처분, 부담이나 조건 등도 함께 승계한 것으로 본다. 다만, 허가양식업자의 지위를 승계한 자가 그 행정처분, 부담이나 조건 등을 알지 못하였음을 증명하는 경우에는 그러하지 아니하다.

⑥ 시장ㆍ군수ㆍ구청장이 제4항에 따라 신고를 수리한 경우나 제1항 단서에 따라 상속인이 허가양식업자의 지위 승계를 반대하는 의사표시를 한 경우에는 종전의 양식업 허가는 제48조제2항에 따른 폐업신고를 한 것으로 본다.

⑦ 시장ㆍ군수ㆍ구청장은 제3항 전단에 따른 신고를 받은 경우에는 「전자정부법」에 따라 「가족관계의 등록 등에 관한 법률」 제11조제4항에 따른 전산정보자료를 공동이용(「개인정보 보호법」 제2조제2호에 따른 처리를 포함한다)할 수 있다.
