액화석유가스의 안전관리 및 사업법 제12조(사업자등의 지위 승계)

① 다음 각 호의 어느 하나에 해당하는 자로서 액화석유가스 사업자등의 지위를 승계하려는 자는 산업통상부령으로 정하는 바에 따라 허가관청이나 등록관청에 신고하여야 한다. <개정 2025.10.1>

② 다음 각 호의 어느 하나에 해당하는 절차에 따라 액화석유가스 사업자등의 시설의 전부를 인수한 자가 종전의 액화석유가스 사업자등의 지위를 승계하려는 경우에는 산업통상부령으로 정하는 바에 따라 허가관청이나 등록관청에 신고하여야 한다. <개정 2025.10.1>

③ 액화석유가스 사업자등이 사망한 경우 그 상속인이 액화석유가스 사업자등의 지위를 승계하려면 피상속인이 사망한 날부터 30일 이내에 산업통상부령으로 정하는 바에 따라 허가관청이나 등록관청에 신고하여야 한다. <개정 2025.10.1>

④ 허가관청이나 등록관청은 제1항부터 제3항까지의 규정에 따른 신고를 받은 경우 그 내용을 검토하여 이 법에 적합하면 신고를 수리하여야 한다. 다만, 액화석유가스 사업자등의 지위를 승계하려는 자(액화석유가스 저장자의 지위를 승계하려는 자는 제외한다)가 제7조 각 호의 어느 하나의 결격사유에 해당하면 신고를 수리하여서는 아니 된다.

⑤ 제1항 또는 제2항에 따른 신고가 수리된 경우 양수인, 합병으로 설립되거나 합병 후 존속하는 법인 또는 액화석유가스 사업자등의 시설의 전부를 인수한 자는 그 양수일, 합병일 또는 인수일부터 종전의 액화석유가스 사업자등의 지위를 승계한다.

⑥ 제3항에 따른 신고가 수리된 경우에는 상속인은 피상속인의 액화석유가스 사업자등으로서의 지위를 승계하며, 피상속인이 사망한 날부터 신고가 수리된 날까지의 기간 동안은 피상속인에 대한 액화석유가스사업의 허가 또는 등록을 상속인에 대한 액화석유가스사업의 허가 또는 등록으로 본다.
