Enforcement Decree of the Child Welfare Act, Article 22-5 (Exercise of Authority within a Limited Scope)

① 법 제20조의2제2항 후단에서 "대통령령으로 정하는 특별한 사유가 있는 경우"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다.

② 시장ㆍ군수ㆍ구청장은 법 제20조의2제4항에 따라 후견인 권한의 남용 여부를 정기적으로 점검하기 위하여 후견인에게 분기별로 후견사무에 관한 자료의 제출을 요구하되, 제출받은 자료의 사실 여부를 확인할 필요가 있는 경우에는 보완 자료를 요청하거나 현장 점검을 실시할 수 있다.

③ 시장ㆍ군수ㆍ구청장은 제2항에 따른 점검 결과 후견인 권한의 남용을 확인한 경우 지체 없이 개선명령, 보호조치 변경 등 후속조치를 취해야 한다.
