Fisheries Cooperatives Act, Article 53-2 (Restrictions on Donation Acts)
① 지구별수협의 임원 선거 후보자, 그 배우자 및 후보자가 속한 기관ㆍ단체ㆍ시설은 해당 임원의 임기 만료일 전 180일(보궐선거 등의 경우에는 그 선거 실시 사유가 확정된 날)부터 해당 선거일까지 선거인(선거인 명부 작성 전에는 선거인 명부에 오를 자격이 있는 사람으로서 이미 조합에 가입한 사람 또는 조합에 가입 신청을 한 사람을 포함한다. 이하 이 조에서 같다)이나, 그 가족 또는 선거인이나 그 가족이 설립ㆍ운영하고 있는 기관ㆍ단체ㆍ시설에 대하여 금전ㆍ물품이나 그 밖의 재산상 이익의 제공, 이익 제공의 의사표시 또는 그 제공을 약속하는 행위(이하 "기부행위"라 한다)를 할 수 없다.
(1) A candidate in an officer election of a district cooperative, his or her spouse, and an institution, organization, or facility to which the candidate belongs may not, from 180 days before the expiration date of the term of the officer concerned (in the case of by-elections, etc., from the date the reason for holding the election is finalized) until the election day, provide money, goods, or other property benefits, express an intention to provide benefits, or promise to provide them (hereinafter referred to as a "donation act") to an elector (before the elector register is prepared, including a person qualified to be entered in the elector register who has already joined the cooperative or has applied to join it; hereinafter the same shall apply in this Article), his or her family, or an institution, organization, or facility established or operated by the elector or his or her family.
② 제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 행위는 기부행위로 보지 아니한다. <개정 2013.3.23, 2014.6.11, 2020.3.24, 2026.3.31>
(2) Notwithstanding paragraph (1), none of the following acts shall be deemed a donation act:
1. 직무상의 행위
1. Acts in the performance of duties:
가. 후보자가 소속된 기관ㆍ단체ㆍ시설(나목에 따른 조합은 제외한다)의 자체 사업계획과 예산으로 하는 의례적(儀禮的)인 금전ㆍ물품 제공 행위(포상 및 화환ㆍ화분 제공 행위를 포함한다)
(a) Customary provision of money or goods (including awards and provision of wreaths and flower pots) under the own business plan and budget of the institution, organization, or facility to which the candidate belongs (excluding a cooperative under item (b));
나. 법령과 정관에 따른 조합의 사업계획 및 수지예산에 따라 집행하는 금전ㆍ물품 제공 행위(포상 및 화환ㆍ화분 제공 행위를 포함한다)
(b) Provision of money or goods executed under the business plan and revenue and expenditure budget of the cooperative in accordance with statutes and its articles of incorporation (including awards and provision of wreaths and flower pots);
다. 물품 구매, 공사, 서비스 등에 대한 대가의 제공 또는 부담금의 납부 등 채무를 이행하는 행위
(c) Performance of obligations, such as providing payment for the purchase of goods, construction, or services or paying contributions;
라. 가목부터 다목까지의 규정에 해당하는 행위 외에 법령의 규정에 근거하여 물품 등을 찬조ㆍ출연 또는 제공하는 행위
(d) Acts other than those under items (a) through (c) of sponsoring, contributing, or providing goods, etc. based on statutory provisions;
2. 의례적 행위
2. Customary acts:
가. 「민법」 제777조에 따른 친족의 관혼상제 의식이나 그 밖의 경조사에 축의ㆍ부의금품을 제공하는 행위
(a) Providing congratulatory or condolence money or goods at rites of passage or other celebrations and condolences of relatives under Article 777 of the Civil Act;
나. 후보자가 「민법」 제777조에 따른 친족이 아닌 사람의 관혼상제 의식에 일반적인 범위에서 축의ㆍ부의금품(화환ㆍ화분을 포함한다)을 제공하거나 주례를 서는 행위
(b) A candidate providing congratulatory or condolence money or goods (including wreaths and flower pots) within the general scope at rites of passage of persons who are not relatives under Article 777 of the Civil Act, or officiating at a wedding;
다. 후보자의 관혼상제 의식이나 그 밖의 경조사에 참석한 하객이나 조객(弔客) 등에게 일반적인 범위에서 음식물이나 답례품을 제공하는 행위
(c) Providing food or return gifts within the general scope to guests or mourners attending the candidate's rites of passage or other celebrations and condolences;
라. 후보자가 그 소속 기관ㆍ단체ㆍ시설(후보자가 임원이 되려는 해당 조합은 제외한다)의 유급(有給) 사무직원 또는 「민법」 제777조에 따른 친족에게 연말ㆍ설 또는 추석에 의례적인 선물을 제공하는 행위
(d) A candidate providing customary gifts at year-end, Lunar New Year, or Chuseok to paid office staff of the institution, organization, or facility to which the candidate belongs (excluding the cooperative concerned for which the candidate intends to become an officer) or to relatives under Article 777 of the Civil Act;
마. 친목회ㆍ향우회ㆍ종친회ㆍ동창회 등 각종 사교ㆍ친목단체 및 사회단체의 구성원으로서 해당 단체의 정관ㆍ규약 또는 운영관례상의 의무에 기초하여 종전의 범위에서 회비를 내는 행위
(e) Paying membership fees within the previous scope, as a member of a social or fraternal organization or social organization such as a fellowship, hometown association, clan association, or alumni association, based on obligations under the organization's articles of incorporation, rules, or operating practices;
바. 후보자가 평소 자신이 다니는 교회ㆍ성당ㆍ사찰 등에 일반적으로 헌금(물품의 제공을 포함한다)하는 행위
(f) A candidate generally making offerings (including provision of goods) to a church, cathedral, temple, etc. that he or she regularly attends;
3. 「공직선거법」 제112조제2항제3호에 따른 구호적(救護的)ㆍ자선적 행위에 준하는 행위
3. Acts equivalent to relief or charitable acts under Article 112 (2) 3 of the Public Official Election Act;
4. 제1호부터 제3호까지의 행위에 준하는 행위로서 해양수산부령으로 정하는 행위
4. Acts equivalent to the acts in subparagraphs 1 through 3 and prescribed by Ordinance of the Ministry of Oceans and Fisheries.
③ 제2항에 따라 일반적인 범위에서 1명에게 제공할 수 있는 축의ㆍ부의금품, 음식물, 답례품 및 의례적인 선물의 금액 범위는 별표와 같다. <개정 2020.3.24>
(3) The range of amounts of congratulatory or condolence money or goods, food, return gifts, and customary gifts that may be provided to one person within the general scope pursuant to paragraph (2) is as set forth in the Table.
④ 누구든지 제1항의 행위를 약속ㆍ지시ㆍ권유ㆍ알선 또는 요구할 수 없다.
(4) No one may promise, instruct, solicit, arrange, or demand the act in paragraph (1).
⑤ 누구든지 해당 선거에 관하여 후보자를 위하여 제1항의 행위를 하거나 하게 할 수 없다.
(5) No one may perform, or cause to be performed, the act in paragraph (1) for a candidate in connection with the election concerned.
⑥ 조합장은 재임 중 제1항에 따른 기부행위를 할 수 없다. 다만, 제2항에 따라 기부행위로 보지 아니하는 행위는 그러하지 아니하다.
(6) The chairperson of the cooperative may not perform a donation act under paragraph (1) during his or her term of office; provided that this shall not apply to acts not deemed donation acts under paragraph (2).
