Enforcement Decree of the Framework Act on Consumers, Article 65 (Requests by Consumer Organizations for Materials and Information, etc.)
①법 제78조제1항에 따라 사업자나 사업자단체에 자료 및 정보의 제공을 요청할 수 있는 소비자단체는 법 제29조에 따라 공정거래위원회나 지방자치단체에 등록된 소비자단체로 한다.
(1) The consumer organizations that may request business operators or business operators' organizations to provide materials and information pursuant to Article 78 (1) of the Act shall be consumer organizations registered with the Fair Trade Commission or a local government under Article 29 of the Act.
②제1항의 소비자단체는 법 제78조제1항에 따라 사업자나 사업자단체에 자료 및 정보의 제공을 요청하는 경우에는 그 자료 및 정보의 요청경위ㆍ사용목적ㆍ내용 및 사용계획 등을 적은 서류를 법 제79조제1항에 따른 소비자정보요청협의회(이하 "협의회"라 한다)에 제출하여야 한다.
(2) Where a consumer organization under paragraph (1) requests a business operator or business operators' organization to provide materials and information pursuant to Article 78 (1) of the Act, it shall submit to the Consumer Information Request Council under Article 79 (1) of the Act (hereinafter referred to as the "Council") a document stating the background, purpose of use, content, and plan of use of the materials and information requested.
③소비자단체가 법 제78조제1항에 따라 사업자나 사업자단체에 요청할 수 있는 자료 및 정보는 다음 각 호의 어느 하나에 해당하는 것으로서 사업자의 영업비밀에 해당하지 아니하는 것이어야 한다.
(3) The materials and information that a consumer organization may request from a business operator or business operators' organization pursuant to Article 78 (1) of the Act shall fall under any of the following and shall not constitute trade secrets of the business operator:
1. 법 제28조제1항제2호에 따른 시험ㆍ검사 및 조사ㆍ분석에 필요한 자료 및 정보
1. Materials and information necessary for tests, inspections, investigations, and analyses under Article 28 (1) 2 of the Act;
2. 제22조제2항 각 호의 시험ㆍ검사기관이 중대한 하자 또는 결함이 있다고 판정한 물품등에 대한 처리계획 및 실적
2. Plans and records of handling concerning goods, etc. determined by a testing and inspection agency in any subparagraph of Article 22 (2) to have a serious flaw or defect.
④협의회는 법 제78조제3항에 따라 협의ㆍ조정을 하는 경우에는 해당 사업자 또는 사업자단체에 의견진술의 기회를 주어야 한다.
(4) When conducting consultation or coordination pursuant to Article 78 (3) of the Act, the Council shall give the relevant business operator or business operators' organization an opportunity to state its opinion.
