소비자기본법 시행령 제18조의3(긴급회의의 구성 및 운영 등)
Enforcement Decree of the Framework Act on Consumers, Article 18-3 (Composition and Operation of Emergency Meetings)
① 국무총리인 정책위원회의 위원장은 긴급회의의 의장이 된다.
(1) The chairperson of the Policy Committee who is the Prime Minister shall be the presiding officer of the emergency meeting.
② 정책위원회의 위원장은 법 제25조의2제1항에 따라 긴급회의를 소집하려는 경우에는 긴급회의 개최일 전에 회의의 일시ㆍ장소 및 안건을 종합적인 대책의 수립과 관계된다고 인정하는 중앙행정기관의 장에게 통보하여야 한다. 다만, 긴급한 사유가 있는 경우에는 그러하지 아니하다.
(2) Where the chairperson of the Policy Committee intends to convene an emergency meeting pursuant to Article 25-2 (1) of the Act, he or she shall notify the heads of central administrative agencies deemed related to the establishment of comprehensive measures of the date, time, place, and agenda of the meeting before the date of the emergency meeting: Provided, That this does not apply where there are urgent grounds.
③ 제2항에 따른 긴급회의의 참석 대상인 중앙행정기관의 장은 관련 대책의 수립에 즉시 착수하는 등 종합대책의 수립에 적극 협력하여야 한다.
(3) The heads of central administrative agencies who are to attend an emergency meeting under paragraph (2) shall actively cooperate in establishing comprehensive measures, such as by immediately commencing the establishment of related measures.
④ 중앙행정기관의 장은 긴급회의에서 종합대책이 마련된 경우 다음 각 호의 사항을 포함한 세부계획을 즉시 수립한 후 정책위원회에 보고하여야 한다.
(4) Where comprehensive measures are prepared at an emergency meeting, the head of a central administrative agency shall immediately establish a detailed plan including the following matters and then report it to the Policy Committee:
1. 해당 물품등의 종류
1. The type of the relevant goods, etc.;
2. 해당 물품등이 인체에 미치는 위해의 종류 및 정도
2. The type and degree of harm that the relevant goods, etc. cause to the human body;
3. 법 제50조에 따른 제조ㆍ수입ㆍ판매 또는 제공의 금지가 필요한 경우 이에 관한 사항
3. Where the prohibition of manufacture, import, sale, or provision under Article 50 of the Act is necessary, matters concerning it;
4. 소비자에 대한 긴급대응요령 등의 교육ㆍ홍보에 관한 사항
4. Matters concerning education and public relations on emergency response guidelines, etc. for consumers;
5. 다른 행정기관의 장의 협조가 필요한 경우 이에 관한 사항
5. Where cooperation from the heads of other administrative agencies is necessary, matters concerning it;
6. 그 밖에 물품등의 위해방지 및 확산을 막기 위하여 필요한 사항
6. Other matters necessary for preventing the harm of goods, etc. and stopping its spread.
⑤ 정책위원회는 중앙행정기관의 장이 보고한 세부계획의 보완을 요구할 수 있다. 이 경우 해당 중앙행정기관의 장은 즉시 보완하여야 한다.
(5) The Policy Committee may request supplementation of the detailed plan reported by the head of a central administrative agency. In such cases, the head of the relevant central administrative agency shall supplement it immediately.
⑥ 중앙행정기관의 장은 수립한 세부계획을 즉시 이행하고 이행상황 및 결과를 정책위원회에 보고하여야 한다.
(6) The head of a central administrative agency shall immediately implement the established detailed plan and report the implementation status and results to the Policy Committee.
⑦ 정책위원회는 종합대책 시행에 필요한 세부계획의 이행상황을 점검하고 그 결과를 공표할 수 있다.
(7) The Policy Committee may check the implementation status of detailed plans necessary for implementing comprehensive measures and publicly announce the results.
⑧ 정책위원회의 위원장은 종합대책의 수립을 위하여 필요한 경우 관련 사업자, 지방자치단체 및 공공기관의 장이나 소속 공무원ㆍ임직원, 관련 전문가를 긴급회의에 참석하게 하여 의견을 듣거나 필요한 자료 또는 의견의 제출 등을 요청할 수 있다.
(8) The chairperson of the Policy Committee may, where necessary for establishing comprehensive measures, have related business operators, local governments, heads of public institutions or their public officials, executives, or employees, or related experts attend an emergency meeting to hear their opinions, or may request them to submit necessary data or opinions.
⑨ 긴급회의에 출석한 사람에게 예산의 범위에서 수당과 여비를 지급할 수 있다. 다만, 공무원이 그 소관업무와 직접 관련되어 출석한 경우에는 그러하지 아니하다.
(9) Allowances and travel expenses may be paid within the budget to persons who attend an emergency meeting: Provided, That this does not apply where a public official attends in direct relation to his or her duties.
