성폭력범죄의 처벌 등에 관한 특례법 제40조의3(19세미만피해자등의 증인신문 장소 등에 대한 특례)

① 법원은 19세미만피해자등을 증인으로 신문하는 경우 사전에 피해자에게 「형사소송법」 제165조의2제1항에 따라 비디오 등 중계장치에 의한 중계시설을 통하여 신문할 수 있음을 고지하여야 한다.

② 19세미만피해자등은 제1항의 중계시설을 통하여 증인신문을 진행할지 여부 및 증인으로 출석할 장소에 관하여 법원에 의견을 진술할 수 있다.

③ 제1항에 따른 중계시설을 통하여 19세미만피해자등을 증인으로 신문하는 경우 그 중계시설은 특별한 사정이 없으면 제30조제1항에 따른 영상녹화가 이루어진 장소로 한다. 다만, 피해자가 다른 장소를 원하는 의사를 표시하거나, 제30조제1항에 따른 영상녹화가 이루어진 장소가 경찰서 등 수사기관의 시설인 경우에는 법원이 중계시설을 지정할 수 있다.
