선박소유자 등의 책임제한절차에 관한 법률 제24조(공탁보정명령 등)

① 책임제한절차 개시의 결정에 대한 즉시항고가 있는 경우에 제11조제1항에 따른 공탁명령에서 정하여진 책임한도액이나 사고발생일, 그 밖에 법원이 정한 이자기산일이 부당하여 공탁된 금액이 부족하다고 인정할 때에는 법원은 신청인에 대하여 14일을 넘지 아니하는 공탁지정일에 그 부족한 책임한도액에 상당하는 금전과 이에 대하여 사고발생일이나 그 밖에 법원이 정하는 기산일부터 공탁지정일까지 연 6퍼센트의 비율로 산정한 이자를 더한 금전이나 부족한 이자계산기간에 해당하는 이자를 책임제한법원에 공탁할 것을 명하여야 한다.

② 책임제한절차 개시의 결정에 대한 즉시항고가 있는 경우에 제13조제4항에 따른 공탁보증의 허가결정에서 정하여진 책임한도액이 부족하다고 인정할 때에는 법원은 신청인에 대하여 14일을 넘지 아니하는 일정한 기간에 그 부족한 책임한도액에 관하여 추가로 제13조제3항에 따른 공탁보증서를 책임제한법원에 제출할 것을 명하여야 한다. 그러나 그 부족한 책임한도액이 제13조제3항에 따른 공탁보증인의 보증한도액을 넘지 아니하는 경우에는 그러하지 아니하다.

③ 제1항 또는 제2항에 따른 결정은 항고인과 신청인에게 송달하여야 한다.

④ 제1항에 따른 명령에 따라 공탁을 한 경우에는 제12조를 준용한다.
