석탄산업전환지역 개발 지원에 관한 특별법 제11조(「관광진흥법」 적용의 특례)

① 문화체육관광부장관은 석탄산업전환지역 중 경제사정이 특히 열악한 지역으로서 대통령령으로 정하는 지역의 한 곳에만 「관광진흥법」 제21조에 따른 허가요건에도 불구하고 같은 법 제5조제1항에 따른 카지노업의 허가를 할 수 있다. 이 경우 카지노업의 허가를 할 때에는 관광객을 위한 숙박시설, 체육시설, 오락시설 및 휴양시설 등(그 시설의 개발추진계획을 포함한다)과의 연계성을 고려하여야 한다. <개정 2025.12.30>

② 제1항에 따른 카지노업의 허가를 받을 수 있는 자는 공공성 및 효율성이 확보되도록 하기 위하여 대통령령으로 정하는 요건에 적합한 자여야 한다.

③ 제1항에 따른 허가를 받은 카지노사업자에 대하여는 「관광진흥법」 제28조제1항제4호를 적용하지 아니한다. 다만, 문화체육관광부장관은 과도한 사행행위(射倖行爲) 등을 사전에 방지하기 위하여 필요한 경우에는 대통령령으로 정하는 바에 따라 출입제한 등 영업에 관한 제한을 할 수 있다.

④ 제1항에 따른 카지노업의 허가기간은 3년 이내에서 대통령령으로 정한다.
