사회기반시설에 대한 민간투자법 제52조(공공부문의 출자)

① 공공부문이 제4조제4호에 따른 방식으로 추진되는 사회기반시설사업을 시행하는 민관합동법인(설립예정인 민관합동법인을 포함한다. 이하 같다)에 출자할 경우 공공부문의 총출자 비율은 대통령령으로 정하는 경우를 제외하고는 50퍼센트 미만으로 한다.

② 공공부문은 제1항의 민관합동법인에 출자하는 경우 「상법」 제369조제1항에도 불구하고 대통령령으로 정하는 경우를 제외하고는 의결권을 행사하지 못한다.

③ 국가 또는 지방자치단체는 민관합동법인에 출자할 때 현물출자가 필요하다고 인정하는 경우에는 「국유재산법」 및 「공유재산 및 물품 관리법」에도 불구하고 다음 각 호의 재산을 현물로 출자할 수 있다.

④ 제3항에 따라 민관합동법인에 출자하는 관리운영권의 출자가액(出資價額)은 국가 또는 지방자치단체가 해당 사회기반시설의 신설ㆍ증설ㆍ개량 또는 운영에 투자한 금액 및 수익성 등을 고려하여 산정한다.
