Private School Teachers and Staff Pension Act, Article 31 (Calculation of Period of Service)

① 이 법에 따른 급여를 계산할 때 교직원의 재직기간은 교직원으로 임용된 날이 속하는 달부터 퇴직한 날의 전날 또는 사망한 날이 속하는 달까지의 연월수(年月數)로 계산한다. 이 경우 개월을 연(年)으로 환산할 때에는 매 1개월을 12분의 1년으로 계산한다.

1. 「병역법」에 따른 현역병 또는 지원하지 아니하고 임용된 부사관으로 복무한 기간(방위소집ㆍ상근예비역소집ㆍ보충역소집 또는 대체역소집에 의하여 복무한 기간 중 대통령령으로 정하는 복무기간을 포함한다)

⑤ 다음 각 호의 기간은 제42조제1항에 따라 준용되는 「공무원연금법」 제28조제4호에 따른 퇴직수당(이하 "퇴직수당"이라 한다)을 지급할 때에는 제1항의 재직기간에 합산하거나 포함하지 아니한다. <개정 2016.5.29, 2018.3.20, 2021.3.23>

⑥ 퇴직수당 지급시 재직기간을 계산할 때에는 다음 각 호의 사유로 인한 휴직을 제외한 휴직기간, 직위해제기간, 정직기간 및 강등에 따라 직무에 종사하지 못하는 기간은 그 기간의 2분의 1을 각각 뺀다. <개정 2013.5.22, 2016.5.29>
