Enforcement Decree of the Special Act on Improvement of Vacant Houses and Small-Scale Housing, Article 24 (Building Deliberation, etc.)
① 법 제26조제1항에서 "건축물의 높이ㆍ층수ㆍ용적률 등 대통령령으로 정하는 사항"이란 다음 각 호의 사항을 말한다. 다만, 사업시행구역이 「국토의 계획 및 이용에 관한 법률」 제51조에 따라 지정된 지구단위계획구역인 경우로서 같은 법 제30조제3항에 따라 중앙도시계획위원회 또는 시ㆍ도도시계획위원회의 심의(건축위원회와 도시계획위원회가 공동으로 하는 심의를 포함한다)를 거친 사항은 제외한다. <개정 2018.12.31, 2019.10.22, 2021.9.17>
(1) "Matters prescribed by Presidential Decree, such as the height, number of floors, and floor area ratio of buildings" in Article 26 (1) of the Act means the following. However, where the project implementation zone is a district unit plan zone designated under Article 51 of the National Land Planning and Utilization Act, matters that have undergone deliberation by the Central Urban Planning Committee or the Si/Do Urban Planning Committee under Article 30 (3) of the same Act (including deliberation jointly conducted by the building committee and the urban planning committee) are excluded:
1. 사업시행구역이 가로주택정비사업을 시행하는 가로구역일 경우 제3조제1항제2호의 요건을 충족하는지 여부에 관한 사항
1. Where the project implementation zone is a street block in which a street housing improvement project is carried out, matters concerning whether the requirements in Article 3 (1) 2 are met;
2. 건축물의 주용도ㆍ건폐율ㆍ용적률 및 높이에 관한 계획(「건축법」 제77조의4에 따라 건축협정을 체결한 경우 건축협정의 내용을 포함한다)
2. The plan on the main use, building coverage ratio, floor area ratio, and height of buildings (including the content of a building agreement where a building agreement has been concluded under Article 77-4 of the Building Act);
3. 건축물의 건축선에 관한 계획

3의2. 「건축법」 제69조에 따른 특별건축구역과 같은 법 제77조의2에 따른 특별가로구역의 지정에 관한 사항
3-2. Matters concerning designation of a special building zone under Article 69 of the Building Act and a special street zone under Article 77-2 of the same Act;
4. 정비기반시설의 설치계획
4. The plan on installation of infrastructure;
5. 공동이용시설의 설치계획
5. The plan on installation of common-use facilities;
6. 환경보전 및 재난방지에 관한 계획
6. The plan on environmental conservation and disaster prevention;
7. 그 밖에 시ㆍ도조례로 정하는 사항
7. Other matters determined by Si/Do ordinance.
② 토지등소유자는 시장ㆍ군수등에게 법 제22조제5항에 따라 주민합의서를 신고하거나 법 제23조제1항 및 제2항에 따라 조합설립인가를 신청하기 전에 다음 각 호의 구분에 따른 사항에 관한 사전결정을 신청할 수 있다. 이 경우 신청 절차, 신청 서류, 통지 등에 관하여는 「건축법」 제10조제5항을 준용한다. <개정 2019.10.22, 2021.9.17>
(2) Before reporting a residents' agreement under Article 22 (5) of the Act or applying for authorization of establishment of an association under Article 23 (1) and (2) of the Act, landowners, etc. may apply to the head of a Si/Gun/Gu, etc. for an advance determination on the matters in the following categories. In such cases, Article 10 (5) of the Building Act shall apply mutatis mutandis to the application procedures, application documents, and notification, etc.:
1. 제3조제1항제1호나목1)부터 3)까지 외의 부분 단서에 따라 같은 목 1)부터 3)까지의 규정에서 정한 기준을 초과하는 자율주택정비사업을 시행하려는 경우: 사업시행구역 내 기존주택의 호수ㆍ세대수의 적정성 여부
1. Where a self-improvement housing project exceeding the standards prescribed in items 1) through 3) of Article 3 (1) 1 (b) is to be carried out under the proviso of the part other than items 1) through 3) of the same item: whether the number of houses or households of existing houses in the project implementation zone is appropriate;
2. 제3조제2항제2호가목 및 나목에 따라 같은 호 각 목 외의 부분 본문에서 정한 기준을 초과하는 가로구역에서 가로주택정비사업을 시행하려는 경우: 사업시행구역의 규모와 정비기반시설 및 공동이용시설의 적정성 여부
2. Where a street housing improvement project is to be carried out in a street block exceeding the standards prescribed in the main text of the part preceding the items of Article 3 (2) 2 under items (a) and (b) of the same subparagraph: whether the scale of the project implementation zone and the infrastructure and common-use facilities are appropriate.
