방송통신발전 기본법 제37조의2(재난 시 무선통신시설의 공동이용 등)

① 이동통신서비스(「전기통신사업법」 제2조제18호에 따른 이동통신서비스를 말한다. 이하 같다)를 제공하는 주요통신사업자는 이동통신서비스 이용자가 방송통신재난이 발생한 경우에도 이동통신서비스를 제공받을 수 있도록 다른 이동통신사업자와의 협정 체결, 시스템 구축 등 무선통신시설의 공동이용을 위하여 필요한 조치를 취하여야 한다. <개정 2025.1.21>

② 과학기술정보통신부장관은 다음 각 호의 요건에 모두 해당하는 경우 이동통신사업자가 다른 이동통신사업자에게 무선통신시설의 공동이용을 허용하도록 명할 수 있다.

③ 제2항에 따른 무선통신시설의 공동이용 대가는 무선통신시설의 공동이용을 허용한 이동통신사업자가 「전기통신사업법」 제38조에 따라 다른 전기통신사업자(「전기통신사업법」 제2조제8호의 전기통신사업자를 말한다)와 협정을 체결한 해당연도의 도매제공 대가를 기준으로 하는 것을 원칙으로 한다. 다만, 무선통신시설의 공동이용 대가와 관련하여 이동통신사업자 간 별도의 협정이 있을 경우 이에 따른다.

④ 제1항부터 제3항까지에서 규정한 사항 외에 무선통신시설의 공동이용의 범위, 절차 및 방법 등에 관하여 필요한 사항은 과학기술정보통신부장관이 정하여 고시한다.
