발명진흥법 제11조의2(직무발명보상 우수기업 인증 등)

① 지식재산처장은 제11조제1항에 따른 직무발명보상제도의 활성화를 위하여 직무발명보상제도를 모범적으로 운영하는 기업을 직무발명보상 우수기업(이하 "우수기업"이라 한다)으로 인증할 수 있다. <개정 2024.2.6, 2025.10.1>

(1) The^ð더 Minister미너스터 of어^v브 Intellectual인털렉추얼 Property프^r라퍼티 may메이 certify서터^f파이 an앤 enterprise엔터프^r라이즈 that^ð댓 exemplarily에그짐플레^r릴리 operates아퍼^r레잇츠 an앤 employee엠플로이이 invention인^v벤션 compensation캄펀세이션 system시스텀 as애즈 an앤 excellent엑설런트 employee엠플로이이 invention인^v벤션 compensation캄펀세이션 enterprise엔터프^r라이즈 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 an앤 "excellent엑설런트 enterprise")엔터프^r라이즈 in인 order오더 to투 vitalize^v바이털라이즈 the^ð디 employee엠플로이이 invention인^v벤션 compensation캄펀세이션 system시스텀 under언더 Article아터클 11 (1).

② 우수기업 인증을 받고자 하는 기업은 지식재산처장에게 신청하여야 한다. <신설 2024.2.6, 2025.10.1>

(2) An앤 enterprise엔터프^r라이즈 that^ð댓 intends인텐즈 to투 obtain어브테인 certification서터^f퍼케이션 as애즈 an앤 excellent엑설런트 enterprise엔터프^r라이즈 shall섈 apply어플라이 to투 the^ð더 Minister미너스터 of어^v브 Intellectual인털렉추얼 Property.프^r라퍼티

③ 지식재산처장은 제2항에 따른 인증신청을 받은 경우에는 인증을 받으려는 기업에 대한 심사를 하고, 인증기준에 적합하면 유효기간을 정하여 인증을 하여야 한다. <신설 2024.2.6, 2025.10.1>

(3) Upon어판 receiving^r러시^v빙 an앤 application애플러케이션 for^f포 certification서터^f퍼케이션 under언더 paragraph패^r러그^r래^f프 (2), the^ð더 Minister미너스터 of어^v브 Intellectual인털렉추얼 Property프^r라퍼티 shall섈 examine이그재민 the^ð디 enterprise엔터프^r라이즈 seeking시킹 certification서터^f퍼케이션 and,앤드 if이^f프 it잇 meets밋츠 the^ð더 certification서터^f퍼케이션 standards,스탠더즈 shall섈 grant그^r랜트 certification서터^f퍼케이션 for^f포 a어 specified스페서^f파이드 validity^v벌리더티 period.피^r리어드

④ 지식재산처장은 인증받은 우수기업이 다음 각 호의 어느 하나에 해당하는 경우에는 그 인증을 취소할 수 있다. 다만, 제1호에 해당하는 경우에는 인증을 취소하여야 한다. <신설 2024.2.6, 2025.10.1>

(4) The^ð더 Minister미너스터 of어^v브 Intellectual인털렉추얼 Property프^r라퍼티 may메이 revoke^r리^v보우크 the^ð더 certification서터^f퍼케이션 of어^v브 a어 certified서터^f파이드 excellent엑설런트 enterprise엔터프^r라이즈 if이^f프 it잇 falls^f폴즈 under언더 any에니 of어^v브 the^ð더 following:^f팔로잉 Provided,프^r러^v바이디드 That^ð댓 certification서터^f퍼케이션 shall섈 be비 revoked^r리^v보우크트 in인 cases케이시즈 falling^f팔링 under언더 subparagraph서브패^r러그^r래^f프 1:

⑤ 국가 및 지방자치단체는 인증받은 우수기업에 대하여 대통령령으로 정하는 바에 따라 행정적ㆍ재정적 지원을 할 수 있다. <신설 2024.2.6>

(5) The^ð더 State스테잇 and앤드 local로우클 governments거^v버먼츠 may메이 provide프^r러^v바이드 administrative어드미너스트^r레이티^v브 and앤드 financial^f퍼낸실 support서포트 to투 certified서터^f파이드 excellent엑설런트 enterprises,엔터프^r라이지즈 as애즈 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree.디크^r리

⑥ 우수기업 인증의 기준, 절차, 재인증, 유효기간, 그 밖에 인증에 필요한 사항은 대통령령으로 정한다. <개정 2024.2.6>

(6) The^ð더 standards스탠더즈 and앤드 procedures프^r러시저즈 for^f포 certification서터^f퍼케이션 of어^v브 excellent엑설런트 enterprises,엔터프^r라이지즈 recertification,^r리서터^f퍼케이션 validity^v벌리더티 period,피^r리어드 and앤드 other어^ð더 matters매터즈 necessary네서세^r리 for^f포 certification서터^f퍼케이션 shall섈 be비 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree.디크^r리
