민간임대주택에 관한 특별법 제21조(「국토의 계획 및 이용에 관한 법률」 등에 관한 특례)

「주택법」 제15조에 따른 사업계획승인권자 또는 「건축법」 제11조에 따른 허가권자(이하 "승인권자등"이라 한다)는 임대사업자가 공공지원민간임대주택을 건설하기 위하여 「주택법」 제15조에 따른 사업계획승인을 신청하거나 「건축법」 제11조에 따른 건축허가를 신청하는 경우에 관계 법령에도 불구하고 다음 각 호에 따라 완화된 기준을 적용할 수 있다. 다만, 공공지원민간임대주택과 공공지원민간임대주택이 아닌 시설을 같은 건축물로 건축하는 경우 전체 연면적 대비 공공지원민간임대주택 연면적의 비율이 50퍼센트 이상의 범위에서 대통령령으로 정하는 비율 이상인 경우에 한정한다. <개정 2016.1.19, 2018.1.16>
