마약류 불법거래 방지에 관한 특례법 제4조(세관 절차의 특례)

① 세관장은 「관세법」 제246조에 따라 화물을 검사할 때에 화물에 마약류가 감추어져 있다고 밝혀지거나 그러한 의심이 드는 경우, 그 마약류의 분산을 방지하기 위하여 충분한 감시체제가 확보되어 있는 마약류범죄의 수사에 관하여 그 마약류가 외국으로 반출되거나 대한민국으로 반입될 필요가 있다는 검사의 요청이 있을 때에는 다음 각 호의 조치를 할 수 있다. 다만, 그 조치를 하는 것이 관세 관계 법령의 입법 목적에 비추어 타당하지 아니하다고 인정할 때에는 요청한 검사와의 협의를 거쳐 그 조치를 하지 아니할 수 있다.

② 제1항(같은 항 제1호는 제외한다)은 「관세법」 제257조에 따라 우편물을 검사할 때에 그 물건에 마약류가 감추어져 있는 것이 밝혀지거나 그러한 의심이 드는 경우에 준용한다. 이 경우 그 마약류에 대하여는 「관세법」 제240조를 적용하지 아니한다.

③ 사법경찰관은 제1항 및 제2항에 따라 요청을 할 것을 검사에게 신청할 수 있다. 이 경우 검사가 제1항 및 제2항에 따른 요청을 한다.
