도로법 시행령 제32조(타공작물의 관리자 등에 대한 도로공사의 시행명령 등)

① 도로관리청은 법 제33조제1항, 제35조제1항 또는 제37조에 따라 도로공사를 시행하게 하는 경우에는 국토교통부령으로 정하는 도로공사 시행 명령서에 설계도서를 첨부하여야 한다.

② 제1항에 따른 도로공사가 준공되었을 때에는 타공작물의 관리자, 도로공사 외의 공사(이하 "타공사"라 한다)의 시행자나 도로공사 외의 행위(이하 "타행위"라 한다)를 한 자 또는 공공단체나 사인(私人)은 국토교통부령으로 정하는 바에 따라 지체 없이 준공조서ㆍ설계도서와 비용정산서를 갖추어 도로관리청의 준공검사를 받아야 한다. 다만, 타공작물의 관리자, 타공사의 시행자나 타행위를 한 자가 행정청인 경우에는 미리 도로관리청과 협의하여야 한다.

③ 도로관리청은 법 제33조제1항 또는 제37조에 따라 타공작물의 관리자, 공공단체 또는 사인에게 도로의 유지ㆍ관리를 하게 하는 경우에는 국토교통부령으로 정하는 도로의 유지ㆍ관리 명령서에 유지ㆍ관리 방법에 관한 설명서와 비용예산서를 첨부하여야 한다.
