대한민국과 아메리카합중국 간의 상호방위조약 제4조에 의한 시설과 구역 및 대한민국에서의 합중국군대의 지위에 관한 협정의 실시에 따른 관세법 등의 임시특례에 관한 법률 제8조(관세 면제 물품의 양도 제한)

① 면세대상자나 면세대상자였던 자가 협정에 따라 관세를 면제받은 물품을 대한민국 내에서 비면세대상자에게 양도(양도를 위하여 그 위탁을 받은 자 또는 알선을 하는 자에게 소지하게 하는 것을 포함한다. 이하 같다)하려는 경우에는 세관장의 승인을 받아야 한다.

② 세관장은 제1항에 따른 승인을 하기 위하여 필요하면 해당 물품을 보세구역(「관세법」 제156조제1항에 따라 세관장이 허가한 장소를 포함한다. 이하 같다)에 반입(搬入)시키거나 소속 공무원에게 해당 물품을 검사하게 할 수 있다.

③ 관세청장은 필요하다고 인정할 때에는 제1항에 따른 양도의 승인을 제한할 수 있는 범위를 고시한다.

④ 제1항에 따른 승인을 받지 아니하고 물품을 양도한 자는 「관세법」 제241조에 따른 신고를 하지 아니하고 물품을 수입한 자로 본다. 이 경우 「관세법」 제269조제2항 및 제271조제2항을 적용한다.

⑤ 제1항의 경우에는 「관세법」 제283조부터 제319조까지의 규정을 준용한다.
