농어촌정비법 제25조(환지계획)

① 농업생산기반 정비사업 시행자는 농업생산기반 정비사업 시행을 위하여 필요하면 사업 시행 전의 토지를 대신하여 사업 시행 후의 토지를 정하고, 이로 인하여 생긴 이해관계의 불균형을 금전으로 청산하게 하기 위한 환지계획을 세워야 한다.

② 환지계획에서 환지는 종전의 토지와 상응하여야 하되, 농업생산기반 정비사업 시행에 따른 환지는 농업경영의 합리화에 기여할 수 있도록 집단 지정하여야 한다.

③ 환지를 받을 수 있는 자는 토지등기부상의 토지 소유자여야 한다.

④ 환지계획에는 농림축산식품부령으로 정하는 바에 따라 다음 각 호의 사항이 포함되어야 한다. <개정 2013.3.23>

⑤ 농업생산기반 정비사업 시행에 따른 환지는 농경지로 지정함을 원칙으로 한다. 다만, 생활환경정비사업 병행 시 토지 소유자가 신청하거나 동의할 경우에는 비농경지로 지정할 수 있다.

⑥ 환지로 지정되는 면적은 대통령령으로 정하는 바에 따라 산정한 면적과 비교하여 토지 소유자별로 증감 폭이 100분의 20 이내가 되도록 하여야 한다. 다만, 그 산정한 면적의 100분의 20에 해당하는 면적이 1천제곱미터 미만이면 1천제곱미터까지 늘리거나 줄일 수 있다.

⑦ 국공유지나 한국농어촌공사 소유가 아닌 토지 중 지목이 구거(溝渠: 도랑), 도로, 하천, 제방(둑) 또는 유지(웅덩이)인 토지로서 실제 경작하지 아니한 경우와 환지계획구역에 1천제곱미터 이하의 토지 소유자가 있는 경우에는 환지를 지정하지 아니하고 금전으로 청산한다. 다만, 제40조에 따른 수혜자총회의 의결(대의원회의 의결로 수혜자총회의 의결을 갈음하는 경우를 포함한다)이 있을 경우에는 1천제곱미터 이하의 토지 소유자에게도 환지를 지정할 수 있다.

⑧ 농업생산기반 정비사업 시행자는 제1항에 따라 환지계획을 수립할 때에 종전 토지의 전부 또는 일부에 소유권 외의 권리 또는 처분 제한이 있는 경우 종전 토지와 교환될 토지에 그 소유권 외의 권리 또는 처분 제한의 목적이 되는 부분을 지정하여야 한다.
