농어촌정비법 제126조(수리계)

① 시장ㆍ군수ㆍ구청장은 「한국농어촌공사 및 농지관리기금법」 제11조에 따른 공사관리지역 밖의 농업생산기반시설의 유지ㆍ관리를 위하여 필요하다고 인정하면 그 농업생산기반시설의 이용자를 계원으로 하는 수리계를 조직ㆍ운영하고 농업생산기반시설의 유지ㆍ관리업무를 위탁할 수 있다.

② 수리계의 조직과 운영에 필요한 사항은 농림축산식품부령으로 정하는 기준에 따라 시ㆍ군 또는 광역시 자치구의 조례로 정한다. <개정 2012.2.17, 2013.3.23>

③ 수리계는 시장ㆍ군수ㆍ구청장의 인가를 받아 계원으로부터 농업생산기반시설의 유지ㆍ관리를 위한 경비를 징수할 수 있다.

④ 수리계는 제3항에 따른 경비를 체납한 자가 있으면 대통령령으로 정하는 바에 따라 관할 시장ㆍ군수ㆍ구청장에게 징수를 의뢰할 수 있다. 이 경우 수리계는 대통령령으로 정하는 수수료를 해당 시장ㆍ군수ㆍ구청장에게 내야 한다.

⑤ 시장ㆍ군수ㆍ구청장은 제4항에 따라 경비 징수를 의뢰받으면 지방세 체납처분의 예에 따라 징수할 수 있다.

⑥ 국가나 지방자치단체는 예산의 범위에서 농업생산기반시설의 유지ㆍ관리 등 수리계의 운영에 필요한 비용의 전부 또는 일부를 수리계에 보조할 수 있다.
