Agricultural and Fishery Disaster Countermeasures Act, Article 4 (Subsidies and Support)
① 국가와 지방자치단체는 재해대책에 드는 비용(재해 이전까지 생산에 투입된 비용을 포함한다)을 전부 또는 최대한 보조하고 재해를 입은 농가와 어가에 대한 지원을 하여야 한다. 다만, 「재난 및 안전관리 기본법」, 「야생생물 보호 및 관리에 관한 법률」 등 다른 법령에 따라 국가 또는 지방자치단체가 같은 종류의 보상금, 지원금 또는 보험금 등을 지급하는 경우에는 그 보상금, 지원금 또는 보험금 등에 상당하는 금액은 지급하지 아니하되, 이 법에 따른 지원금보다 「농어업재해보험법」 및 「풍수해ㆍ지진재해보험법」에 따라 실제 수령한 보험금이 적은 경우 그 차액을 지원할 수 있다. <개정 2011.3.9, 2011.7.28, 2014.3.24, 2023.10.24, 2024.2.13, 2025.4.22, 2025.8.14>
(1) The State and local governments shall subsidize all or, to the maximum extent possible, the costs of disaster countermeasures (including costs invested in production before the disaster) and provide support to farming and fishing households affected by disasters. However, where the State or a local government pays the same type of compensation, support funds, or insurance proceeds under other statutes such as the Framework Act on the Management of Disasters and Safety and the Act on the Protection and Management of Wildlife, an amount equivalent to such compensation, support funds, or insurance proceeds shall not be paid; provided that where insurance proceeds actually received under the Agricultural and Fishery Disaster Insurance Act and the Storm and Flood Damage and Earthquake Insurance Act are less than the support funds under this Act, the difference may be provided.

(2) Subsidies and support provided by the State and local governments under paragraph (1) to farming households affected by disasters shall be as follows:
1. 가뭄 피해 대책의 경우
1. In the case of countermeasures for drought damage:
가. 양수(揚水)를 하였을 때에는 그 양수에 든 유류대금(油類代金) 및 전기료
(a) Where water has been pumped, fuel costs and electricity charges for pumping;
나. 양수기와 양수용 발동기의 구입비
(b) Costs of purchasing water pumps and pump engines; and
다. 양수용 펌프와 관정(管井)의 시설비
(c) Costs of installing pumps and tube wells for pumping;
2. 농작물이나 산림작물의 병해충을 방제하는 경우: 농약대금
2. Where pests and diseases of crops or forest crops are controlled: costs of pesticides;
3. 농작물이나 산림작물을 다시 심는 경우: 종묘대금 및 비료대금 등 재해 이전까지 투입된 생산비용의 전부 또는 일부
3. Where crops or forest crops are replanted: all or part of production costs invested before the disaster, such as costs of seeds, seedlings, and fertilizers;
4. 유실(流失)되거나 매몰된 농경지를 복구하는 경우: 복구비
4. Where farmland that has been washed away or buried is restored: restoration costs;
5. 유실되거나 파손된 농업용 시설 또는 임업용 시설을 복구하는 경우: 시설비 및 철거비
5. Where agricultural facilities or forestry facilities that have been washed away or damaged are restored: facility costs and demolition costs;
6. 유실되었거나 죽은 가축을 갈음하여 새로 가축을 기르는 경우: 어린 가축의 구입비
6. Where new livestock are raised to replace livestock that were washed away or died: costs of purchasing young livestock;
7. 유실되거나 매몰된 초지(草地)를 복구하는 경우: 복구비
7. Where grassland that has been washed away or buried is restored: restoration costs;

8의2. 농작물이나 산림작물을 다시 심거나 새로 가축을 기르기 위하여 농작물ㆍ산림작물 또는 가축을 폐기하는 것이 필요한 경우: 폐기비
8-2. Where it is necessary to dispose of crops, forest crops, or livestock in order to replant crops or forest crops or to raise new livestock: disposal costs; and
9. 재해를 입은 농가의 생계 안정과 경영 유지를 위하여 지원하는 경우
9. Where support is provided to stabilize the livelihood and maintain the management of farming households affected by disasters:
가. 이재민의 구호
(a) Relief for disaster victims;
나. 고등학생의 학자금 면제
(b) Exemption from tuition for high school students;
다. 영농자금(營農資金) 등 농림축산식품부장관이 정하여 고시하는 농업정책자금의 상환기한 연기 및 그 이자의 감면
(c) Extension of the repayment period and reduction or exemption of interest on agricultural policy funds notified by the Minister of Agriculture, Food and Rural Affairs, such as farming funds; and
라. 정부 양곡의 지급 등
(d) Provision of government grain, etc.; and
10. 그 밖의 지원 사항
10. Other support matters.
③ 국가와 지방자치단체가 제1항에 따라 재해를 입은 어가에 대하여 하는 보조와 지원은 다음 각 호에 따른다. <개정 2011.3.9, 2014.3.24, 2015.6.22, 2017.3.21, 2022.6.10, 2025.8.14>
(3) Subsidies and support provided by the State and local governments under paragraph (1) to fishing households affected by disasters shall be as follows:
1. 어업재해로 인한 수산양식물의 피해가 있는 경우
1. Where aquaculture products are damaged by a fishery disaster:
가. 수산종자대금 등 재해 이전까지 투입된 생산비용의 전부 또는 일부
(a) All or part of production costs invested before the disaster, such as costs of fish seed; and
나. 죽은 양식물의 철거비
(b) Costs of removing dead farmed organisms;
2. 유실되거나 파손된 어업용 시설을 복구하는 경우: 시설비 및 철거비
2. Where fishery facilities that have been washed away or damaged are restored: facility costs and demolition costs;
3. 재해를 입은 어가의 생계 안정과 경영 유지를 위하여 지원하는 경우
3. Where support is provided to stabilize the livelihood and maintain the management of fishing households affected by disasters:
가. 이재민의 구호

다. 영어자금(營漁資金) 등 해양수산부장관이 정하여 고시하는 수산업정책자금의 상환기한 연기 및 그 이자의 감면
(c) Extension of the repayment period and reduction or exemption of interest on fishery policy funds notified by the Minister of Oceans and Fisheries, such as fishing funds; and
라. 정부 양곡의 지급 등
(d) Provision of government grain, etc.; and
4. 적조현상 또는 이상수온으로 수산양식물 중 어류를 긴급 방류한 경우: 입식비(入殖費)
4. Where fish among aquaculture products are urgently released due to red tides or abnormal water temperatures: stocking costs.
④ 국가와 지방자치단체는 재해를 입은 농가와 어가에 제2항제3호 및 제3항제1호가목에 따라 생산비용의 전부 또는 일부를 지원하는 경우 보험목적물 여부, 농가와 어가의 농어업재해보험 가입 여부 등을 고려하여 지원 수준을 달리 정할 수 있다. <신설 2025.8.14>
(4) Where the State and local governments support all or part of production costs under paragraph (2) 3 and paragraph (3) 1 (a) to farming and fishing households affected by disasters, they may set different support levels in consideration of whether the objects are insured objects and whether the farming and fishing households have subscribed to agricultural and fishery disaster insurance.
⑤ 국가와 지방자치단체는 농가 또는 어가가 재해로 인한 정전(停電) 등 대통령령으로 정하는 사유로 인하여 피해를 입은 경우에는 제2항 및 제3항에 따른 재해를 입은 농가 또는 어가에 준하는 보조 및 지원을 할 수 있다. <신설 2014.3.24, 2025.8.14>
(5) Where a farming or fishing household suffers damage due to a reason prescribed by Presidential Decree, such as a power outage caused by a disaster, the State and local governments may provide subsidies and support equivalent to those for farming or fishing households affected by disasters under paragraphs (2) and (3).
⑥ 국가와 지방자치단체는 재해를 입은 어가가 원상복구를 하지 아니하고 그 어업권 또는 양식업권을 반납하여 폐업하는 경우 제2항이나 제3항에 상당하는 금액을 보조하거나 지원할 수 있다. <개정 2014.3.24, 2019.8.27, 2025.8.14>
(6) Where a fishing household affected by a disaster surrenders its fishing right or aquaculture right and closes its business without restoring the original state, the State and local governments may subsidize or support an amount equivalent to that under paragraph (2) or (3).
⑦ 국가와 지방자치단체는 재해의 예방을 위하여 농가 및 어가에 대통령령으로 정하는 시설 및 장비의 구입비, 설치비 및 운영비를 보조 및 지원할 수 있다. <신설 2014.3.24, 2025.8.14>
(7) For disaster prevention, the State and local governments may subsidize and support farming and fishing households for the costs of purchasing, installing, and operating facilities and equipment prescribed by Presidential Decree.
⑧ 국가와 지방자치단체는 농가와 어가에 대한 보조 및 지원의 기준을 정하는 경우 실거래가 수준으로 정하여야 한다. <신설 2025.8.14>
(8) When setting the standards for subsidies and support for farming and fishing households, the State and local governments shall set them at the level of actual transaction prices.
⑨ 국가와 지방자치단체는 농어업재해보험 상품 미출시 등 불가피한 사유로 농어업재해보험에 가입하지 못한 농가 및 어가에 대한 대책을 마련하여야 한다. <신설 2025.8.14>
(9) The State and local governments shall prepare countermeasures for farming and fishing households that could not subscribe to agricultural and fishery disaster insurance due to unavoidable reasons, such as the absence of an insurance product on the market.
⑩ 제2항부터 제9항까지에 따른 농가와 어가에 대한 보조 및 지원의 기준과 방법에 관하여는 「재난 및 안전관리 기본법」을 준용하되, 같은 법에 규정되어 있지 아니한 사항에 대하여는 농림축산식품부 및 해양수산부의 공동부령(이하 "공동부령"이라 한다)으로 정한다. <개정 2013.3.23, 2014.3.24, 2025.8.14>
(10) The Framework Act on the Management of Disasters and Safety applies mutatis mutandis to the standards and methods of subsidies and support for farming and fishing households under paragraphs (2) through (9), and matters not provided for in that Act shall be prescribed by joint Ordinance of the Ministry of Agriculture, Food and Rural Affairs and the Ministry of Oceans and Fisheries (hereinafter referred to as "joint Ordinance").
⑪ 국가와 지방자치단체는 제1항에 따른 농가와 어가에 대한 보조 및 지원에 필요한 재원(財源)을 확보하여야 한다. <개정 2014.3.24, 2025.8.14>
(11) The State and local governments shall secure the financial resources necessary for subsidies and support for farming and fishing households under paragraph (1).
