군인연금법 제20조(다른 법령에 따른 급여와의 조정)

① 다른 법령에 따라 국가나 지방자치단체의 부담으로 이 법에 따른 급여와 같은 종류의 급여(「국가유공자 등 예우 및 지원에 관한 법률」 제11조 또는 「보훈보상대상자 지원에 관한 법률」 제10조에 따른 보훈급여금은 제외한다)를 받은 사람에게는 그 급여금에 상당하는 금액에 대해서는 이 법에 따른 급여를 지급하지 아니한다.

② 퇴직연금 또는 조기퇴직연금, 「별정우체국법」 제25조의2에 따른 퇴직연금 또는 조기퇴직연금, 「군인 재해보상법」 제26조에 따른 상이연금(이하 "상이연금"이라 한다)을 받을 권리가 있는 사람이 이 법에 따른 퇴역유족연금을 함께 받게 된 경우에는 퇴역유족연금액의 2분의 1을 빼고 지급한다. <개정 2026.6.9>

③ 동일인에게 퇴역연금과 상이연금을 지급할 사유가 발생한 경우에는 본인에게 유리한 급여를 하나만 선택하게 하여 지급한다.

④ 상이연금을 받을 권리가 있는 사람에게는 제28조에 따른 퇴직일시금(이하 "퇴직일시금"이라 한다)을 지급하지 아니한다.

(4) The^ð더 lump-sum럼프-섬 retirement^r리타이어먼트 allowance얼라원스 under언더 Article아터클 28 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð더 "lump-sum럼프-섬 retirement^r리타이어먼트 allowance")얼라원스 shall섈 not낫 be비 paid페이드 to투 a어 person퍼슨 entitled엔타이틀드 to투 receive^r러시^v브 a어 disability디서빌리티 pension.펜션

⑤ 퇴역연금을 받을 권리가 있는 군인이 사망한 경우 해당 유족이 「군인 재해보상법」 제35조에 따른 순직유족연금(순직유족연금을 갈음하여 「군인 재해보상법」 제36조에 따른 순직유족연금일시금을 받는 경우를 포함한다. 이하 이 조에서 같다) 수급권을 갖게 되었을 때에는 퇴역유족연금과 「군인 재해보상법」 제35조에 따른 순직유족연금(이하 "순직유족연금"이라 한다) 중 하나를 선택하여 받을 수 있다.

⑥ 제5항에도 불구하고 20년 이상 재직한 군인이 재직 중 사망한 후 그 유족이 퇴역유족연금일시금을 선택한 경우 해당 유족이 순직유족연금 수급권을 갖게 되었을 때에는 퇴역유족연금일시금과 순직유족연금 중 하나를 선택하여 받을 수 있다.

⑦ 20년 미만 재직한 군인이 재직 중 사망한 경우 해당 유족이 순직유족연금 수급권을 갖게 되었을 때에는 제35조제1항에 따른 퇴직유족일시금과 순직유족연금 중 하나를 선택하여 받을 수 있다.
