군에서의 형의 집행 및 군수용자의 처우에 관한 법률 시행령 제67조(통화내용의 청취ㆍ녹음)

① 소장은 법 제45조제2항에 따라 전화통화를 허가할 때에는 법 제42조제2항 각 호의 어느 하나에 해당하지 아니한다고 명백히 인정되는 경우 외에는 군수용자의 통화내용을 청취 또는 녹음하는 것을 조건으로 붙여야 한다.

② 소장은 제45조제4항에 따라 군수용자에게 전화통화를 하기 전에 미리 통화내용을 청취하거나 녹음한다는 사실을 말이나 서면 등 적절한 방법으로 알려주어야 한다.

③ 제1항에 따라 녹음한 기록물은 「공공기록물 관리에 관한 법률」에 따라 관리하고, 특히 녹음한 기록물이 손상되지 않도록 그 보존에 주의하여야 한다.

④ 군교도관은 군수용자 전화통화의 청취ㆍ녹음을 통하여 알게 된 내용을 누설하거나, 권한 없이 처리하거나, 타인의 이용에 제공하는 등 부당한 목적으로 사용해서는 아니 된다.

⑤ 제1항에 따라 녹음한 기록물을 관계 기관에 제공하는 것에 관하여는 제57조제3항 및 제4항을 준용한다.
