관세법 시행령 제69조(덤핑방지관세의 소급부과)

1. 실질적 피해등이 있다고 최종판정이 내려진 경우 또는 실질적인 피해등의 우려가 있다는 최종판정이 내려졌으나 잠정조치가 없었다면 실질적인 피해등이 있다는 최종판정이 내려졌을 것으로 인정되는 경우에는 잠정조치가 적용된 기간동안 수입된 물품

2. 비교적 단기간내에 대량 수입되어 발생되는 실질적 피해등의 재발을 방지하기 위하여 덤핑방지관세를 소급하여 부과할 필요가 있는 경우로서 당해 물품이 과거에 덤핑되어 실질적 피해등을 입힌 사실이 있었던 경우 또는 수입자가 덤핑사실과 그로 인한 실질적 피해등의 사실을 알았거나 알 수 있었을 경우에는 잠정조치를 적용한 날부터 90일전 이후에 수입된 물품

3. 법 제54조제1항에 따른 약속(이하 이 호에서 "약속"이라 한다)을 위반하여 잠정조치가 적용된 물품의 수입으로 인한 실질적 피해등의 사실이 인정되는 경우에는 잠정조치를 적용한 날부터 90일전 이후에 수입된 물품(재정경제부장관이 필요하다고 인정한 경우 약속을 위반한 물품으로 한정할 수 있다). 이 경우 약속위반일 이전에 수입된 물품을 제외한다.
