공유재산 및 물품 관리법 제42조(신탁개발)

① 일반재산(토지와 그 정착물로 한정한다. 이하 이 절에서 같다)은 부동산신탁을 취급하는 신탁업자에게 신탁하여 개발할 수 있다. <개정 2021.4.20>

② 제1항에 따른 신탁을 할 때에는 이 법에 위반되는 무상대부ㆍ교환 또는 양여의 효과를 달성하기 위한 목적으로 신탁하거나 해당 지방자치단체 외의 자를 신탁의 수익자로 하여서는 아니 된다.

③ 제1항에 따른 신탁의 종류는 다음 각 호와 같다.

⑤ 제4항의 신탁기간은 갱신할 수 있다. 이 경우 갱신기간은 갱신할 때마다 제4항에 따른 신탁기간을 초과할 수 없다.
