공유재산 및 물품 관리법 시행령 제95조의2(고유식별정보의 처리)
Article 95-2 (Processing of Personally Identifiable Information)
①지방자치단체의 장은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호에 따른 주민등록번호가 포함된 자료를 처리할 수 있다. <개정 2015.2.16, 2015.7.20, 2022.4.20>
(1) Where unavoidable for performing the following affairs, the head of a local government may process data containing resident registration numbers under Article 19, subparagraph 1 of the Enforcement Decree of the Personal Information Protection Act:
1. 법 제7조에 따른 기부채납 사무
1. Affairs concerning donation and acceptance under Article 7 of the Act;
2. 법 제13조에 따른 영구시설물 축조 금지 관련 사무
2. Affairs related to the prohibition of construction of permanent structures under Article 13 of the Act;
3. 법 제20조 및 제29조에 따른 행정재산의 사용허가 및 일반재산의 대부 관련 사무
3. Affairs related to use permits for administrative property and leases of general property under Articles 20 and 29 of the Act;
4. 법 제27조, 제42조 및 제43조의2에 따른 행정재산의 관리위탁, 일반재산의 신탁 및 위탁 관련 사무
4. Affairs related to management entrustment of administrative property and trust and entrustment of general property under Articles 27, 42, and 43-2 of the Act;
5. 법 제36조, 제39조 및 제40조에 따른 일반재산의 매각, 교환 및 양여 관련 사무
5. Affairs related to sale, exchange, and grant of general property under Articles 36, 39, and 40 of the Act;
6. 법 제43조의5에 따른 지식재산의 사용허가등 관련 사무
6. Affairs related to use permits, etc. for intellectual property under Article 43-5 of the Act;
7. 법 제44조에 따른 공유재산 실태조사 관련 사무
7. Affairs related to fact-finding surveys of public property under Article 44 of the Act;
8. 법 제74조 및 제79조에 따른 물품의 대부 및 교환 관련 사무
8. Affairs related to lease and exchange of commodities under Articles 74 and 79 of the Act;
9. 법 제76조 및 제78조에 따른 불용품의 매각 및 양여 관련 사무
9. Affairs related to sale and grant of disused goods under Articles 76 and 78 of the Act;
10. 법 제80조 및 제81조에 따른 연체료 및 변상금 등의 징수 관련 사무
10. Affairs related to collection of late fees and indemnity, etc. under Articles 80 and 81 of the Act;
11. 법 제82조에 따른 과오납금의 반환 관련 사무
11. Affairs related to refund of erroneously or excessively paid amounts under Article 82 of the Act;
12. 법 제83조에 따른 원상복구명령 등 관련 사무
12. Affairs related to orders for restoration to original state, etc. under Article 83 of the Act;
13. 법 제84조에 따른 은닉된 공유재산 신고 관련 사무
13. Affairs related to reporting of concealed public property under Article 84 of the Act.
② 법 제27조에 따른 행정재산의 관리위탁을 받은 자는 같은 조 제5항 및 제6항에 따른 전대(轉貸), 이용료의 징수 및 행정재산의 관리에 관한 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호에 따른 주민등록번호가 포함된 자료를 처리할 수 있다. <신설 2015.2.16, 2015.7.20>
(2) A person entrusted with management of administrative property under Article 27 of the Act may process data containing resident registration numbers under Article 19, subparagraph 1 of the Enforcement Decree of the Personal Information Protection Act where unavoidable for performing affairs concerning subleasing, collection of usage charges, and management of administrative property under paragraphs (5) and (6) of the same Article.
③ 법 제43조의2에 따른 수탁기관은 위탁재산의 관리ㆍ처분에 관한 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호에 따른 주민등록번호가 포함된 자료를 처리할 수 있다. <신설 2015.2.16>
(3) An entrusted institution under Article 43-2 of the Act may process data containing resident registration numbers under Article 19, subparagraph 1 of the Enforcement Decree of the Personal Information Protection Act where unavoidable for performing affairs concerning management and disposal of entrusted property.
