공무원연금법 제41조(다른 법령 등에 따른 급여와의 조정)

① 다른 법령에 따라 국가나 지방자치단체의 부담으로 이 법에 따른 급여와 같은 종류의 급여를 받는 사람에게는 그 급여에 상당하는 금액을 이 법에 따른 급여에서 빼고 지급한다.

② 「군인연금법」, 「사립학교교직원 연금법」 또는 「별정우체국법」에 따른 퇴역연금ㆍ퇴직연금 또는 조기퇴직연금의 수급자가 이 법에 따른 퇴직유족연금을 함께 받게 된 경우에는 퇴직유족연금액의 2분의 1을 빼고 지급한다.

③ 제59조에 따른 비공무상 장해급여와 「공무원 재해보상법」 제28조에 따른 장해급여 수급권이 함께 발생한 경우에는 그 중 하나를 선택하여 받을 수 있다.

④ 퇴직연금 또는 조기퇴직연금을 받을 권리가 있는 공무원이 사망한 경우 해당 유족이 「공무원 재해보상법」 제36조에 따른 순직유족연금(이하 "순직유족연금"이라 한다) 또는 같은 법 제38조에 따른 위험직무순직유족연금(이하 "위험직무순직유족연금"이라 한다) 수급권을 갖게 되었을 때에는 제54조제1항에 따른 퇴직유족연금과 순직유족연금 또는 위험직무순직유족연금 중 하나를 선택하여 받을 수 있다.

⑤ 제4항에도 불구하고 10년 이상 재직한 공무원이 재직 중 사망한 후 그 유족이 제54조제4항에 따른 퇴직유족연금일시금을 선택한 경우, 해당 유족이 순직유족연금 또는 위험직무순직유족연금 수급권을 갖게 되었을 때에는 퇴직유족연금일시금과 순직유족연금 또는 위험직무순직유족연금 중 하나를 선택하여 받을 수 있다.

⑥ 10년 미만 재직한 공무원이 재직 중 사망한 경우 해당 유족이 순직유족연금 또는 위험직무순직유족연금 수급권을 갖게 되었을 때에는 제58조제1항에 따른 퇴직유족일시금과 순직유족연금 또는 위험직무순직유족연금 중 하나를 선택하여 받을 수 있다.
