공무원연금법 제40조(급여 상호 간의 조정)

① 퇴직연금 또는 조기퇴직연금의 수급자가 본인의 퇴직연금 또는 조기퇴직연금 외에 퇴직유족연금을 함께 받게 된 경우에는 퇴직유족연금액의 2분의 1을 빼고 지급한다.

② 퇴직연금 또는 퇴역연금의 수급자가 제26조에 따라 재직기간을 합산받은 후 다시 퇴직하거나 사망한 경우에는 퇴직연금(퇴직연금공제일시금을 포함한다), 조기퇴직연금(퇴직연금공제일시금을 포함한다) 또는 퇴직유족연금(퇴직유족연금부가금을 포함한다)만을 받을 수 있으며, 이를 갈음하여 퇴직연금일시금 또는 퇴직유족연금일시금을 받을 수 없다.

③ 조기퇴직연금의 수급자가 제26조에 따라 재직기간을 합산받은 후 다시 퇴직하거나 사망한 경우에는 조기퇴직연금(퇴직연금공제일시금을 포함한다) 또는 퇴직유족연금(퇴직유족연금부가금을 포함한다)만을 받을 수 있으며, 이를 갈음하여 퇴직연금일시금 또는 퇴직유족연금일시금을 받을 수 없다. 이 경우 조기퇴직연금액은 재직기간을 합산하여 계산한 퇴직연금액에 재임용 전의 지급률을 적용한 금액으로 한다.

④ 제43조에 따른 퇴직연금과 제59조에 따른 비공무상 장해급여는 함께 지급하지 아니한다.
