행정절차법 제10조(지위의 승계)

① 당사자등이 사망하였을 때의 상속인과 다른 법령등에 따라 당사자등의 권리 또는 이익을 승계한 자는 당사자등의 지위를 승계한다.

② 당사자등인 법인등이 합병하였을 때에는 합병 후 존속하는 법인등이나 합병 후 새로 설립된 법인등이 당사자등의 지위를 승계한다.

(2) Where웨어 a어 corporation,코퍼^r레이션 etc.엣세터^r러 that^ð댓 is이즈 a어 party,파티 etc.엣세터^r러 merges,머지즈 the^ð더 corporation,코퍼^r레이션 etc.엣세터^r러 surviving서^v바이^v빙 the^ð더 merger머저 or오 the^ð더 corporation,코퍼^r레이션 etc.엣세터^r러 newly눌리 established이스태블리시트 by바이 the^ð더 merger머저 shall섈 succeed석시드 to투 the^ð더 status스태터스 of어^v브 the^ð더 party,파티 etc.엣세터^r러

③ 제1항 및 제2항에 따라 당사자등의 지위를 승계한 자는 행정청에 그 사실을 통지하여야 한다.

④ 처분에 관한 권리 또는 이익을 사실상 양수한 자는 행정청의 승인을 받아 당사자등의 지위를 승계할 수 있다.

⑤ 제3항에 따른 통지가 있을 때까지 사망자 또는 합병 전의 법인등에 대하여 행정청이 한 통지는 제1항 또는 제2항에 따라 당사자등의 지위를 승계한 자에게도 효력이 있다.
