해양수산생명자원의 확보ㆍ관리 및 이용 등에 관한 법률 제19조(지정의 취소 등)

① 해양수산부장관은 기탁등록보존기관이 다음 각 호의 어느 하나에 해당하는 경우에는 그 지정을 취소하거나 시정을 명할 수 있다. 다만, 제1호의 경우에는 그 지정을 취소하여야 하고, 제2호 및 제3호의 경우에는 해양수산부장관으로부터 시정명령을 받은 날부터 60일 이내에 정당한 사유 없이 이를 이행하지 아니한 때에 그 지정을 취소하여야 한다. <개정 2024.1.23>

② 제1항에 따라 지정이 취소된 때에는 해당 기탁등록보존기관을 운영하는 자는 취소된 날부터 15일 이내에 제18조제1항 후단에 따른 기탁등록보존기관의 지정증서를 해양수산부장관에게 반납하여야 한다. 이 경우 해양수산부장관은 해당 기탁등록보존기관에 대하여 해양수산생명자원의 이양을 요청할 수 있다.

③ 제1항에 따라 기탁등록보존기관의 지정이 취소된 때에는 그 취소된 날부터 2년 이내에 이를 다시 지정할 수 없다.

④ 제1항부터 제3항까지의 규정에 따른 처분의 기준과 절차 등에 필요한 사항은 대통령령으로 정한다.
