지진ㆍ지진해일ㆍ화산의 관측 및 경보에 관한 법률 제11조의2(검정대행기관의 지정 등)

① 기상청장은 제11조에 따른 검정업무를 전문적으로 수행하기 위하여 지진ㆍ지진해일ㆍ화산의 관측 장비를 검정할 수 있는 기관을 지정하여 검정업무의 전부 또는 일부를 대행하게 할 수 있다.

② 제1항에 따른 지정을 받으려는 자는 대통령령으로 정하는 인력 및 설비를 갖추어 기상청장에게 신청하여야 한다.

③ 기상청장은 제1항에 따라 지정된 기관(이하 "검정대행기관"이라 한다)의 적절성 유지 여부를 확인하기 위하여 검정대행기관을 출입ㆍ조사할 수 있으며, 관련 자료의 제출을 요구할 수 있다.

④ 기상청장은 제3항에 따른 조사 결과, 검정대행기관의 검정업무 수행이 부적합하다고 인정되는 경우에는 그 결과를 통보하고 개선을 요구하여야 한다.

⑤ 기상청장은 검정대행기관이 다음 각 호의 어느 하나에 해당하면 3개월 이내의 기간을 정하여 시정을 명할 수 있다.

⑥ 제1항에 따른 지정의 기준 및 방법 등에 필요한 사항은 환경부령으로 정한다.
