지방공무원법 제30조의4(파견근무)

① 임용권자는 그 업무수행과 관련된 행정 지원이나 연수, 그 밖에 능력개발 등을 위하여 필요하면 소속 공무원을 지방자치단체의 다른 기관, 다른 지방자치단체, 국가기관, 공공단체, 「공공기관의 운영에 관한 법률」 제4조제1항 각 호에 해당하는 기관(「지방공기업법」에 따른 지방직영기업, 지방공사 및 지방공단을 포함한다), 국내외의 교육기관ㆍ연구기관, 그 밖의 기관에 일정 기간 파견근무하게 할 수 있으며, 전문성이 특히 요구되는 특수업무의 효율적 수행 등을 위하여 필요하면 인사위원회의 의결을 거쳐 지방자치단체 외의 기관ㆍ단체의 임직원을 파견받아 근무하게 할 수 있다.

② 파견권자는 파견 사유가 소멸되거나 파견 목적이 달성될 가망이 없으면 그 공무원을 지체 없이 원래의 소속 기관에 복귀시켜야 한다.

③ 제1항에 따라 지방자치단체 외의 기관ㆍ단체에서 파견된 임직원은 직무상 행위를 할 때에는 공무원으로 본다. 「형법」이나 그 밖의 법률에 따른 벌칙을 적용할 때에도 또한 같다.

④ 공무원을 파견근무하게 하거나 지방자치단체 외의 기관ㆍ단체의 임직원을 파견받아 근무하게 하는 경우 파견 사유ㆍ기간ㆍ절차와 파견기간 중의 복무, 그 밖에 필요한 사항은 대통령령으로 정한다.
