① 제주4ㆍ3사건의 진상을 규명하고, 이 법에 따라 희생자 및 유족을 심사ㆍ결정하며, 그들의 명예회복 및 보상 등에 관한 사항을 심의ㆍ의결하기 위하여 국무총리 소속으로 제주4ㆍ3사건진상규명및희생자명예회복위원회(이하 "위원회"라 한다)를 둔다. <개정 2022.1.11>

③ 위원회는 위원장 1명을 포함한 25명 이내의 위원으로 구성한다.

④ 위원장은 국무총리가 되고 위원은 법무부장관ㆍ국방부장관ㆍ행정안전부장관ㆍ보건복지부장관ㆍ기획예산처장관ㆍ법제처장 및 제주특별자치도지사, 국회가 추천하는 4명(대통령이 소속되거나 소속되었던 정당의 교섭단체가 추천하는 2명, 그 외 교섭단체가 추천하는 2명으로 구성한다)과 유족 대표를 포함한 학식과 경험이 풍부한 사람 중에서 국무총리가 임명하거나 위촉한다. 이 경우 위원의 임기는 2년으로 하되 한 차례만 연임할 수 있다. <개정 2025.10.1>

⑤ 위원회는 위원회의 업무 중 추가 진상조사에 관한 사항을 처리하기 위하여 분과위원회를 둔다. 이 경우 분과위원회의 위원에는 제4항에 따라 국회가 추천하는 4명의 위원이 포함되어야 하고, 분과위원회의 위원장은 국회가 추천하는 위원 중에서 위원회의 위원장이 정한다.

⑥ 위원회는 위원회의 업무 중 보상금등의 지급 결정에 관한 사항을 처리하기 위하여 보상심의분과위원회를 둔다. <신설 2022.1.11>

⑦ 위원회는 그 업무수행에 필요한 사항의 자문을 위하여 자문기구를 둘 수 있다. <개정 2022.1.11>
