전자상거래 등에서의 소비자보호에 관한 법률 제39조(「독점규제 및 공정거래에 관한 법률」의 준용)

① 이 법에 따른 공정거래위원회의 심의ㆍ의결에 관하여는 「독점규제 및 공정거래에 관한 법률」 제64조부터 제68조까지 및 제93조를 준용한다. <개정 2020.12.29>

② 이 법 위반행위에 대한 공정거래위원회, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장의 조사 등에 관하여는 「독점규제 및 공정거래에 관한 법률」 제81조제1항ㆍ제2항ㆍ제3항ㆍ제6항 및 제9항을 준용한다. <개정 2020.12.29>

③ 이 법에 따른 공정거래위원회의 처분 및 제38조에 따라 위임된 시ㆍ도지사의 처분에 대한 이의신청, 시정조치명령의 집행정지, 문서의 송달, 소의 제기 및 불복의 소의 전속관할에 관하여는 「독점규제 및 공정거래에 관한 법률」 제96조, 제97조, 제98조, 제98조의2, 제98조의3 및 제99조부터 제101조까지를 준용한다. <개정 2020.12.29, 2024.2.6, 2026.1.20>

④ 이 법에 따른 과징금의 부과ㆍ징수에 관하여는 「독점규제 및 공정거래에 관한 법률」 제103조부터 제107조까지의 규정을 준용한다. <신설 2018.6.12, 2020.12.29>

⑤ 이 법에 따른 직무에 종사하거나 종사하였던 공정거래위원회의 위원, 공무원 및 제32조의2에 따른 동의의결의 이행관리 업무를 담당하거나 담당하였던 사람에 대하여는 「독점규제 및 공정거래에 관한 법률」 제119조를 준용한다. <개정 2018.6.12, 2020.12.29, 2026.1.20>

(5) Article아터클 119 of어^v브 the^ð더 Monopoly머나펄리 Regulation^r레귤레이션 and앤드 Fair^f페어 Trade트^r레이드 Act액트 shall섈 apply어플라이 mutatis뮤타티즈 mutandis뮤탠디즈 to투 members멤버즈 and앤드 public퍼블릭 officials어^f피실즈 of어^v브 the^ð더 Fair^f페어 Trade트^r레이드 Commission커미션 who후 are아 or오 were워 engaged엔게이지드 in인 duties두티즈 under언더 this^ð디스 Act,액트 and앤드 to투 persons퍼슨즈 who후 are아 or오 were워 in인 charge차지 of어^v브 managing매너징 the^ð디 implementation임플러멘테이션 of어^v브 consent컨센트 decisions디시전즈 under언더 Article아터클 32-2.

⑥ 제32조의2에 따른 동의의결의 이행관리 업무를 담당하거나 담당하였던 사람에 대하여는 「독점규제 및 공정거래에 관한 법률」 제123조제2항을 준용한다. <신설 2026.1.20>
