전자상거래 등에서의 소비자보호에 관한 법률 제20조의3(통신판매의 중요한 일부 업무를 수행하는 통신판매중개업자의 책임)
Act on Consumer Protection in Electronic Commerce, Article 20-3 (Liability of Mail Order Brokerage Business Operators That Perform Important Parts of Mail Order Sales)
통신판매에 관한 거래과정에서 다음 각 호의 업무를 수행하는 통신판매중개업자는 통신판매업자가 해당 각 호의 각 목에 따른 의무를 이행하지 아니하는 경우에는 이를 대신하여 이행하여야 한다. 이 경우 제7조 및 제8조의 "사업자"와 제13조제2항제5호 및 제14조제1항의 "통신판매업자"는 "통신판매중개업자"로 본다.
Where a mail order brokerage business operator performs any of the following tasks in the course of a mail order transaction and the mail order seller fails to perform the duties under the items of the relevant subparagraph, the mail order brokerage business operator shall perform them in its place. In such cases, "business operator" in Articles 7 and 8 and "mail order seller" in Article 13 (2) 5 and Article 14 (1) shall be deemed to be "mail order brokerage business operator":
1. 통신판매중개업자가 청약의 접수를 받는 경우
1. Where the mail order brokerage business operator receives offers:
가. 제13조제2항제5호에 따른 정보의 제공
(a) Provision of information under Article 13 (2) 5;
나. 제14조제1항에 따른 청약의 확인
(b) Confirmation of offers under Article 14 (1);
다. 그 밖에 소비자피해를 방지하기 위하여 필요한 사항으로서 대통령령으로 정하는 사항
(c) Other matters prescribed by Presidential Decree as necessary to prevent damage to consumers;
2. 통신판매중개업자가 재화등의 대금을 지급받는 경우
2. Where the mail order brokerage business operator receives payment for goods, etc.:
가. 제7조에 따른 조작 실수 등의 방지
(a) Prevention of operating errors, etc. under Article 7;
나. 제8조에 따른 전자적 대금지급의 신뢰 확보
(b) Ensuring trust in electronic payments under Article 8;
다. 그 밖에 소비자피해를 방지하기 위하여 필요한 사항으로서 대통령령으로 정하는 사항
(c) Other matters prescribed by Presidential Decree as necessary to prevent damage to consumers.
