유전자원의 접근ㆍ이용 및 이익 공유에 관한 법률 제9조(국내 유전자원등에 대한 접근 신고 등)

① 국내 유전자원등의 이용을 목적으로 접근하려는 외국인, 재외국민, 외국기관 및 국제기구와 그 밖에 이에 준하는 자로서 기후에너지환경부령으로 정하는 자는 대통령령으로 정하는 바에 따라 국가책임기관의 장에게 신고하여야 한다. <개정 2025.10.1>

② 제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 신고 등의 절차를 거친 경우에는 제1항에 따른 신고를 한 것으로 본다. <개정 2018.12.24>

③ 제1항에 따라 신고한 자가 대통령령으로 정하는 사항을 변경하려는 경우에는 국가책임기관의 장에게 변경신고를 하여야 한다.

④ 국내 유전자원등의 이용을 목적으로 접근하려는 내국인은 그 유전자원등의 제공국(유전자원등의 원산지 국가로서 이를 제공하는 국가 또는 유전자원등을 「생물다양성에 관한 협약」에 따라 적법하게 취득하여 제공하는 국가를 말한다. 이하 같다)이 대한민국임을 확인받기 위하여 필요한 경우 등 대통령령으로 정하는 경우에는 국가책임기관의 장에게 제1항 및 제3항에 따른 신고를 할 수 있다.
