Enforcement Decree of the Act on Postal Savings and Postal Insurance, Article 4 (Transmission of Documents for Claiming Insurance Money under Actual-Loss Medical Insurance Contracts)
① 실손의료보험(실제로 부담한 의료비만을 지급하는 보험을 말한다. 이하 같다)계약의 보험계약자, 피보험자, 보험수익자 또는 대리인(이하 "보험계약자등"이라 한다)은 법 제45조의2제1항에 따라 「국민건강보험법」 제42조에 따른 요양기관(이하 "요양기관"이라 한다)에 실손의료보험계약의 보험금 청구에 필요한 서류의 전송을 요청하는 경우에는 피보험자의 진료내역을 확인해야 한다.
(1) The policyholder, insured, beneficiary or agent (hereinafter referred to as the "policyholder, etc.") of an actual-loss medical insurance contract (meaning insurance that pays only medical expenses actually borne; the same applies hereinafter) shall verify the medical treatment history of the insured when requesting a medical care institution under Article 42 of the National Health Insurance Act (hereinafter referred to as a "medical care institution") to transmit documents necessary for claiming insurance money under the actual-loss medical insurance contract, pursuant to Article 45-2 (1) of the Act.
② 법 제45조의2제1항의 요청을 받은 요양기관은 보험계약자등의 요청에 따라 실손의료보험계약의 보험금 청구에 필요한 서류를 체신관서에 전송하는 경우에는 다음 각 호의 요건을 모두 갖추어 전송해야 한다.
(2) A medical care institution that has received a request under Article 45-2 (1) of the Act shall, when transmitting documents necessary for claiming insurance money under the actual-loss medical insurance contract to the postal authority at the request of the policyholder, etc., meet all of the following requirements in transmitting them:
1. 정보처리장치로 처리가 가능한 형태일 것

2. 암호화 등 안전성 확보 및 개인정보 보호 등을 위한 조치로서 과학기술정보통신부장관이 정하여 고시하는 조치를 할 것
2. Measures to ensure security, such as encryption, and to protect personal information, as determined and publicly notified by the Minister of Science and ICT, shall be taken.
③ 법 제45조의2제2항에서 "대통령령으로 정하는 정당한 사유"란 다음 각 호의 사유를 말한다.
(3) The "justifiable grounds prescribed by Presidential Decree" in Article 45-2 (2) of the Act means the following grounds:
1. 법 제45조의3제1항에 따른 전산시스템(이하 "실손전산시스템"이라 한다)에 전산장애가 발생하거나 실손전산시스템의 보수ㆍ점검 등으로 전송할 수 없는 경우
1. Where transmission is impossible owing to a computer system failure of the computer system under Article 45-3 (1) of the Act (hereinafter referred to as the "actual-loss computer system") or maintenance or inspection of the actual-loss computer system;
2. 「전자금융거래법」 제2조제22호에 따른 전자적 침해행위가 발생한 경우로서 개인정보 보호 등을 위하여 실손전산시스템을 차단할 필요가 있는 경우
2. Where an electronic intrusion under subparagraph 22 of Article 2 of the Electronic Financial Transactions Act has occurred and it is necessary to block the actual-loss computer system to protect personal information, etc.;
3. 실손전산시스템에 의한 서류 전송을 위하여 시스템 연계 등 사전절차를 진행하고 있는 경우로서 과학기술정보통신부장관이 정하여 고시하는 경우
3. Where preliminary procedures such as system linkage are in progress for transmission of documents through the actual-loss computer system, as determined and publicly notified by the Minister of Science and ICT;
4. 그 밖에 제1호부터 제3호까지에 준하는 경우로서 과학기술정보통신부장관이 정하여 고시하는 경우
4. Other cases equivalent to subparagraphs 1 through 3, as determined and publicly notified by the Minister of Science and ICT.
