아동복지법 시행령 제21조의5(보호대상아동의 가정 복귀 결정)

① 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 법 제16조제3항 본문에 따라 보호대상아동을 가정으로 복귀시키려는 경우에는 사례결정위원회의 심의를 거쳐야 한다.

② 법 제16조제3항 단서에서 "대통령령으로 정하는 상담ㆍ교육ㆍ심리적 치료 등"이란 법 제45조에 따른 아동보호전문기관(이하 "아동보호전문기관"이라 한다)의 장이 법 제46조제2항제3호에 따라 아동학대행위자 및 아동학대사례관리대상자에게 제공하는 다음 각 호의 상담ㆍ교육 및 심리치료를 말한다. <개정 2026.8.4>
